Abstract
Pada skripsi ini, penulis mengangkat permasalahan Implementasi Pasal 17 Ayat (1) Peraturan Daerah Kota Malang Nomor 4 Tahun 2009 tentang Pengelolaan Tempat Parkir. Penulis mengangkat permasalahan tersebut karena dilatar belakangi masih belum terlaksana dengan baik dalam pengelolaan tempat parkir di tepi jalan umum, dan masih banyak kekurangan dalam hal pelayanan pemberian karcis parkir kepada pengguna jasa parkir di tepi jalan umum Kota Malang. Berdasarkan latar belakang tersebut, maka penulis menarik rumusan masalah sebagai berikut : 1) Bagaimana Implementasi Pasal 17 ayat (1) Peraturan Daerah Kota Malang Nomor 4 Tahun 2009 tentang pengelolaan tempat parker terhadap pelayanan parkir di tepi jalan umum ? 2) Apa Kendala Yang Dihadapi Oleh Dinas Perhubungan Kota Malang dalam melaksanakan Peraturan Daerah Kota Malang terkait pengelolaan tempat parkir di kota Malang ? 3) Bagaimana Upaya yang dilakukan oleh Dinas Perhubungan Kota Malang dalam melaksanakan Peraturan Daerah tentang Pengelolaan tempat parkir terkait pelayanan parkir selama ini ? Dalam skripsi ini penulis menggunakan metode yuridis empiris, yaitu penelitian yang difokuskan pada berlakunya aturan hukum di dalam masyarakat. Data primеr adalah informasi pеngalaman, pеndapat, harapan, dan lain-lain dari subyеk pеnеlitian data ini dapat sеcara langsung dari dеngan mеnggunakan mеtodе wawancara sеcara langsung kеpada narasumbеr atau rеspondеn sеbagai sumbеr utama yaitu pеtugas pengawas parkir Dinas Perhubungan Kota Malang. Data sеkundеr adalah data yang dipеrolеh dari informasi yang bеrupa dokumеn arsip, laporan, notulеnsi yang rеsmi. Data sеkundеr yang di butuhkan dalam pеnеlitian ini mеrupakan data sеkundеr, yang mеncakup data hukum dan data yang di pеrolеh dari pihak Dinas Perhubungan Kota Malang yang tеrkait dalam pеnеlitian ini. Dari hasil penelitian yang didapatkan dengan menggunakan metode diatas, penulis menemukan jawaban atas permasalahan yang dirumuskan. Bahwa Implementasi Pasal 17 Ayat (1) Peraturan Daerah Kota Malang Nomor 4 Tahun 2009 tersebut belum terlaksana dengan baik karena masih banyak juru parkir yang tidak terpantau oleh staff pengawas dinas perhubungan, dan masih banyak juru parkir yang tidak memberikan karcis parkir kepada pengguna jasa parkir, dan juga kurangnya jumlah staff pengawas parkir sehingga sulit untuk menjangkau seluruh titik parkir di kota Malang. Hambatan dalam pelaksanaan Peraturan Daerah tersebut dikarenakan beberapa faktor. Faktor Internal, kurangnya jumlah staff pengawas parkir, jam operasional yang terpusat pada jam kerja, fasilitas penunjang yang masih kurang. Faktor Eksternal, masalah eksternal timbul dari masyarakat yang tetap membayar parkir tanpa diberi karcis parkir. Upaya yang dilakukan diantaranya melalui ix penambahan jumlah staff pengawas parkir, serta pembinaan juru parkir dan sosialisasi kepada masyarakat kota Malang.
English Abstract
In this thesis, the authors raised the problem of Implementation of Article 17 Paragraph (1) of Malang District Regulation No. 4 of 2009 on Parking Management. The authors raised the problem because the background has not been done well in the management of public parking on the road, and there are still many deficiencies in terms of service of parking ticket to parking service users on the public road side of Malang. In this thesis the author employs empirical juridical method, namely research that is focused on the enactment of the rule of law in society. Prime data is information of experience, data, expectation, etc. from the subdivision of data of this data can be directly from using mеtodе interview directly to narasumbеr or rеspondеn as the main sumbestr that is the supervisory officer of Transportation Department of Malang City. Data sеkundеr is data that is derived from information such as document files, reports, notes that are available. The data sеkunde needed in this department is the data sеkundеr, which includes legal data and data in pеrolеh from the Department of Transportation of Malang City which is related in this part of the society. From the results of research obtained by using the above methods, the authors found the answer to the problems formulated. That the Implementation of Article 17 Paragraph (1) of Malang City Regulation Number 4 Year 2009 has not been implemented properly because there are still many parking officers that are not monitored by the supervisory staff of the transportation service, and there are still many parking attendants who do not provide parking tickets to parking service users, and also the lack of parking supervisory staff making it difficult to reach all parking spots in Malang city. Obstacles in the implementation of the Regional Regulation due to several factors. Internal factors, lack of parking supervisory staff, hours of operation centered on working hours, supporting facilities are still lacking. External factors, external problems arise from people who still pay for parking without parking tickets. Efforts undertaken include through the addition of the number of parking supervisory staff, as well as the guidance of the parking attendant and socialization to the people of Malang.
