Abstract
Penelitian tesis ini mengangkat permasalahan tentang kewajiban pendaftaran penyelenggara sistem elektronik bagi seluruh pelaku usaha e-commerce di indonesia yang menjadi salah satu program pemerintah dalam Peraturan Presiden Tahun 74 Tahun 2017 tentang Peta Jalan Sistem Perdagangan Nasional Berbasis Elektronik (Road Map E-commerce) Tahun 2017-2019, dimana salah satu tujuan dari program ini yakni membentuk pengaturan yang mewajibkan pelaku usaha e-commerce lokal maupun asing untuk melakukan pendaftaran. Program ini ditargetkan rampung pada bulan September 2017, namun hingga pertengahan 2019 program ini belum terealisasikan. Berdasarkan hal tersebut, maka peneliti mengangkat rumusan masalah sebagai berikut: (1) Аpаkаh urgensi pendаftаrаn penyelenggаrа sistem elektronik bаgi pelаku usaha e-commerce di Indonesiа? (2) Bаgаimаnа bentuk pengаturаn pendаftаrаn penyelenggаrа sistem elektronik yаng ideаl bаgi pelаku usaha e-commerce di Indonesiа? Penelitian tesis ini menggunakan metode yuridis normatif dengan metode pendakatan conceptual approach, statue approach, dan comparative approach. Metode ini digunakan peneliti untuk mencari jawaban permasalahan sebagai berikut: (1) Pendаftаrаn tersebut dapat me Memudahkan konsumen untuk mengidentifikasi pelaku usaha e-commerce, mendorong perizinan pelaku usaha, mendukung program pengenaan pajak bagi pelaku usaha e-commerce, peningkatan kualitas usaha kecil dan menengah, dan pengontrolan peredaran barang di Indonesia. (2) Untuk membentuk pengaturan yang ideal terkait pendaftaran pelaku usaha e-commerce, pemerintah harus merevisi peraturan-peraturan yang memberikan celah bagi pelaku usaha untuk tidak melakukan pendaftaran. Pelaku usaha harus diwajibkan untuk mencantum nomer identitas usaha dan barcode pada platform penjualan online mereka agar dapat dipindai dan diidetifikasi oleh konsumen terkait informasi usaha dan pelaku usaha melalui website ataupun aplikasi yang dibuat dan dikelola oleh pemerintah.
English Abstract
This research raises the issue of registration obligations of electronic system organizers for all e-commerce businesses in Indonesia. This mandatory registration became one of the government programs in Presidential Regulation 74 of 2017 concerning Road Map of Electronic-Based National Trading System (Road Map of E-commerce) in 2017 - 2019, where one of the objectives of this program is to form a regulation that requires local and foreign e-commerce businesses to register. Initially, this program is set to be completed in September 2017. However, until mid-2019, it has not reached the completion target yet. This delay on completion acts as the precursor to the following research questions: (1) What is the urgency of the registration of electronic system organizers for the implementation for e-commerce businesses in Indonesia? (2) How is the form of arrangement for an ideal registration of electronic system organizers for e-commerce businesses in Indonesia? This research utilizes the normative juridical method combined with the conceptual, statue and comparative approach. This study employs this method during the investigation of the following findings: (1) The registration can facilitate consumers to identify e-commerce businesses, encourage business licensing, support taxation programs for e-commerce businesses, improve the quality of small and medium businesses, and controlling the circulation of goods in Indonesia. (2) To form an ideal arrangement related to the registration of e-commerce businesses, the government should revise regulations that provide a loophole for business actors not to register. Businesses must be required to include business identity numbers and barcodes on their online sales platforms to assist the consumers in scanning and identifying the business information and actors through websites or applications established and managed by the government.
