Abstract
Terdapat putusan yang terdapat pada peradilan tingkat pertama, banding serta kasasi terdapat perbedaan pendapat dari hakim dalam memutus satu perkara yang sama. Berdasarkan latar belakang tersebut diatas, peneliti bermaksud untuk menganalisis pertimbangan hakim dalam memutus perkara khususnya perkara tindak pidana korupsi pengadaan videotron. Pada putusan tingkat pertama dan banding terdakwa diputus bersalah. Namun, pada tingkat kasasi terdakwa diputus bebas oleh hakim. Pada kasus yang diangkat, semua pertimbangan penuntut umum serta Majelis Hakim pada 2 tingkat peradilan sebelumnya yaitu tingkat pertama dan tingkat banding ditolak serta dinyatakan tidak dapat diterima pada tingkat kasasi.Hakim memiliki kewenangan untuk memutus suatu perkara. Pertimbangan hakim sangat mempengaruhi penjatuhan putusan yang diberikan terhadap terdakwa. Hakim harus memiliki ketelitian dan penafsiran yang tinggi. Hakim diharapkan dapat memberikan putusan dengan pertimbangan seadiladilnya dan mendengarkan kedua belah pihak. Putusan hakim sangat memberikan dampak baik positif maupun negatif bagi terdakwa. Dasar pertimbangan para Majelis Hakim pada peradilan tingkat pertama yaitu Pengadilan Tipikor pada Pengadilan Negeri Jakarta Pusat, dasar pertimbangan Majelis Hakim pada peradilan tingkat banding yaitu Pengadilan Tinggi Jakarta, serta dasar pertimbangan para Majelis Hakim pada peradilan tingkat kasasi yaitu Mahkamah Agung mengalami perbedaan didalam amar putusannya.
English Abstract
There was court decision by the fact that there which is found in the judiciary of the the first degree , an appeal as well as procedure there was a gap in the opinion of the judge in charge of one case per confirming it who cut asunder the same. Based on the background mentioned above, researchers intend to analyze consideration the judge in break matter especially matter of corruption procurement videotron. To the award in the first degree and appeal the defendant were found guilty .But , on the level of procedure the defendant were found free by a judge. The author answers to existing problems that the case raised, all considerations of the public prosecutor and the Tribunal Judges on the judicial level 2 before first grade and level of appeal rejected and declared inadmissible at the level of Cassation. The judge has the authority to decide a case .The judge is affecting penjatuhan a verdict rendered against the defendant. Judge to be having greater an interpretation of the high.Judge is expected to provide the award by consideration of judges and listen to both sides.Judicial decisions gives the impact of either positive or negative for the defendant.The judge in the judgment of the court of first instance on judicial tipikor in central jakarta district court , the basis of consideration of appeals court judges in the jakarta high court , and basic judgment of the judge in the court in an appeal to the supreme court had differences in earning his ruling.
