Abstract
Pada skripsi ini penulis membahas tentang pelaksanaan kewajiban izin pemanfaatan tanah dari pemilik hak atas tanah kepada pemilik bangunan gedung berdasar prinsip pemisahan horizontal, kemudian hambatan pelaksanaan izin pemanfaatan tanah tersebut, upaya serta akibat dari tidak terlaksananya kewajiban izin pemanfaatan tanah yang tidak sesuai dengan peraturan perundang-undangan. Penelitian ini dilatar belakangi adanya pelaksanaan kewajiban izin pemanfaatan tanah dari pemilik hak atas tanah kepada pemilik bangunan gedung berdasar prinsip pemisahan horizontal di Kabupaten Situbondo berupa surat pernyataan yang tidak sesuai dengan peraturan perundang-undangan. Berdasarkan hal tersebut, terdapat rumusan masalah: (1) Apakah pelaksanaan kewajiban izin pemanfaatan tanah dari pemilik hak atas tanah kepada pemilik bangunan gedung berdasar prinsip pemisahan horizontal di Kabupaten Situbondo, Jawa Timur sesuai dengan Peraturan Pemerintah Republik Indonesia Nomor 36 Tahun 2005 Tentang Peraturan Pelaksanaan Undang-Undang Nomor 28 Tahun 2002 Tentang Bangunan Gedung? (2) Bagaimana peralihan hak guna bangunan dari badan hukum perseroan terbatas ke badan hukum perseroan terbatas lainnya yang masih dalam satu pemilik? Penulis melakukan penelitian di Kabupaten Situbondo dengan pendekatan kepada pihak-pihak yang terkait. Jenis penelitian pada skripsi ini yaitu yuridis empiris dengan pendekatan penelitian yuridis sosiologis. Jenis serta sumber data yaitu data primer yang diperoleh melalui observasi dan wawancara, data sekunder yang diperoleh melalui beberapa literatur. Berdasarkan hasil penelitian, didapatkan kesimpulan bahwa terdapat salah satu pemohon izin mendirikan bangunan melaksanaan kewajiban izin pemanfaatan tanah dari pemilik hak atas tanah kepada pemilik bangunan gedung berdasar prinsip pemisahan horizontal di Kabupaten Situbondo, Jawa Timur tidak sesuai dengan ketentuan PP RI 36/2005 tentang Pelaksanaan UU RI Nomor 28 Tahun 2002 tentang Bangunan Gedung dan Peraturan Menteri PUPR 05/PRT/M/2016 tentang Izin Mendirikan Bangunan. Hal tersebut dikarenakan izin pemanfaatan tanah berdasar prinsip pemisahan horisontal dibuat dalam bentuk surat pernyataan bukan surat perjanjian. Namun ketidaksesuaian tersebut diterima oleh Dinas terkait yang menangani perizinan karena tetap sesuai dengan SOP Dinas. Akibat dari ketidaksesuaian di atas, pemohon belum melakukan peralihan hak guna bangunan yang seharusnya dilakukan sesuai ketentuan PP RI Nomor 40 Tahun 1996 tentang Hak Guna Usaha, Hak Guna Bangunan, dan Hak Pakai Atas Tanah.
English Abstract
In this final research the writer discussed about the implementation of land use permit obligation from the freehold title owner to the building owner based on horizontal separation, then the obstacles of land use permit implementation, effort and result of the land use permit obligation that is not implemented that not suitable with the law. This research is based on the implementation of land use permit obligation from the freehold title owner to the building owner based on horizontal separation in Situbondo Regency in the form of a statement which is not in accordance with the laws and regulations. Based on this, this paper raises the formulation of the problem: (1) Is the implementation of land use permit obligation from the freehold title owner to the building owner based on horizontal separation in Situbondo Regency, East Java in accordance with the Governmental Regulation of The Republic of Indonesia 36/2005 about the implementation of Law No 28 Year 2002 about Building? (2) How is the transfer of building rights of a legal entity of a limited liability company to a legal entity of another limited liability company still in one owner? The writer did research at Situbondo Regency with approach to the relevant parties. The research type is empirical juridical with sociological juridical approach. data sources of primary data obtained through observation and interview, secondary data obtained from literatures. Based on the results, it was obtained conclusion that there is one of applicants that propose building permit implement the land use permit obligation from the freehold title owner based on horizontal separation principle at the Situbondo Regency suitable with the Governmental Regulation of The Republic of Indonesia 36/2005 about the implementation of Law No 28 Year 2002 about Building and Ministerial Regulation of Public Work and People Housing of The Republic of Indonesia Number 05/PRT/M/2016 about Building Permit. This is because the land use permit based on horizontal separation principle is made in the form of a statement not a letter of agreement. But, the unsuitability is accepted by the relevant agency that handle the permit suitable with the Agency SOP. The result of the unsuitability the applicant do not do building right transfer that should be done suitable with stipulation of Governmental Regulation of The Republic of Indonesia Number 40 Year 1996 about Cultivation Right Title, Building Right Title, and Right To Use Title.
