Abstract

Penelitian ini bertujuan untuk mengetahui Efektivitas Pasal 77 Ayat 1 Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan Terkait Kewajiban Memiliki Surat Izin. Adapun yang menjadi latar belakang penelitian ini adalah karena banyaknya pelanggaran lalu lintas yang dilakukan oleh masyarakat yang mengendarai kendaran bermotor membuat permasalahan ini menjadi penting untuk segera dibentuk suatu upaya penyelesaian yang tepat sehingga dalam pelaksanaanya dapat berjalan dengan efektiv. Penelitian ini merupakan penelitian hukum empiris yang terlibat secara langsung dengan data yang akan diteliti. Pendekatan penelitian menggunakan pendekatan yuridis sosiologis. Jenis dan sumber data penelitian adalah data primer dan data sekunder. Teknik pengumpulan data berupa teknik wawancara dan pembagian kuisioner kepada pihak-pihak yang terkait dan studi kepustakaan. Hasil penelitian menunjukan bahwa dalam pelaksanaannya pasal 77 ayat (1) Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan terkait Kewajiban Memiliki Surat Izin Mengemudi belum berjalan dengan efektif karena dalam penerapannya belum memenuhi faktor pendukung efektifitas suatu peraturan.

English Abstract

This research aims to understand the effectiveness of Article 77 paragraph (1) of the Law Number 22 Year 2009 on Road Traffic and Transportation related to the obligation to have license. The motivation of this research is because a lot of traffic violations that are conducted by society who drive motorized vehicles, make this issue becomes important to form an appropriate solution, so the implementation can be performed effectively. This research is empirical legal research that involves the data directly. The research approach uses sociological jurisprudence approach. Type of research and sources of data are primary and secondary data. Technique of collecting data consist of interview technique, spreading kuesioner to related stakeholders, and study of literature. The result of the research shows that the implementation of Article 77 paragraph (1) of the Law Number 22 Year 2009 on Road Traffic and Transportation related to the obligation to have driving license is still not effective because of its implementation does not yet fulfill the enabling factors of effectiveness of regulations.
