Abstract
Perkembangan ilmu pengetahudainddainbidteaknngormlogii. ssaaniagbatsamtnebmubaebridkarani pengaruh yang besar bagi tegaknya keadilan kemajuan IPTEK adalah media sosial, salah satunya adalah YouTube.yang in ubenYouiTnugbe adalah salah satu media sosial tempat bagi masyrak mempublikasikan karyanya ke dunia maya, namun masih sering ditemukan adanya pelanggaran hak cipta yang dilakukan oleh pengguna aktifnya. Berdasarkan latar belakang tersebut, masih banyak pelanggaran hak cipta yang dilakukan oleh YouTuber selaku pengguna aktif YouTube yang menggunakan video-video ciptaan orang lain untuk dijadikan konten video mereka tanpa adanya izin dari pencipta atau pemegang hak cipta atas video tersebut yang salah satunya terjadi karena kurang jelasnya pengaturan video online sebagai salah satu objek yang dilindungi hak cipta. Untuk menjawab permasalahan diatas, jenis penelitian yang digunakan Penulis adalah penelitian yuridis normatif yang mengkaji rumusan masalah dari sudut pandang perundang-undangan serta regulasi terkait yang berlaku dengan menggunakan pendekatan perundang-undangan, pendekatan kasus dan pendekatan komparatif untuk menjawab isu hukum yang telah dirumuskan. Berdasarkan hasil penelitian diketahui bahwa dalam langkah penegakan hukum sesuai dengan Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta, YouTube membuat aturan terkait dengan ciptaan original. Selain itu Penulis juga membahas mengenai pengaturan video sebagai salah satu ciptaan yang dilindungi oleh Undang-Undang Hak Cipta, bentuk perlindungan untuk pemegang hak cipta untuk melindungi ciptaannya, perbandingan penggunaan 'fair use" yang digunakan oleh Indonesia dengan negara asal YouTube, Amerika dan Upaya hukum yang harus dilakukan jika terjadi suatu pelanggaran hak cipta yang terjadi di media sosial YouTube. Dapat disimpulkan bahwa video yang ditayangkan di YouTube adalah suatu bentuk dari karya audio visual yang dapat dilindungi oleh Hak Cipta, yang telah memiliki perlindungan hukum yang juga secara khusus diatur oleh YouTube dengan adanya lisensi Standar YouTube dan lisensi Creative Commons dimana dalam penggunaannya oleh orang lain haruslah mendapatkan izin terlebih dahulu dari pihak Pemegang Hak Cipta atau Pencipta. Sedangkan upaya untuk perlindungan dan penyelesaian sengketa juga telah diatur dalam Undang-Undang Hak Cipta, selain itu YouTube yang dituangkan dalam kebijakannya jugs telah mengatur tentang upaya dalam perlindungan video sebagai obyek hak cipta serta cara penyelesaian sengketanya, walaupun cara penyelesaian sengketa dalam YouTube ini belum dapat mengakomodir kebutuhan dari pengguna sebagai subyek hukum.
English Abstract
The development of science and technology greatly give a big influence for the establishment of justice in the field of IPR. One fruit of the progress of Science and Technology is social media, one of which is YouTube. YouTube is one of the social media places for people who want to publish their work to the virtual world, but still often found the existence of copyright violations committed by active users. Based on this background, there are still many copyright infringement committed by YouTuber as an active YouTube user who uses other people's videos to make their video content without permission from the creator or copyright holder of the video, one of which occurred because of the lack of clarity setting up online video as one of the objects protected by copyright. To answer the problems above, the type of research used by the author is a normative juridical study that examines the formulation of the problem from the point of view of legislation as well as related regulations applicable by using the approach of legislation, case approach and comparative approach to answer legal issues that have been formulated. Based on the results of the research note that in law enforcement measures in accordance with Law No. 28 of 2014 on Copyright, YouTube makes the rules associated with the original creation. In addition, the author also discusses the arrangement of video as one of the creatures protected by the Copyright Act, a form of protection for the copyright holders to protect their creation, the comparison of the use of 'fair use" used by Indonesia with the origin country of YouTube, America and the effort of law which must be done in the event of a copyright infringement taking place on YouTubers social media. It can be concluded that the video displayed on YouTube is a form of audio-visual work that can be protected by Copyright, which already has legal protection that is also specifically regulated by YouTube in the presence of a YouTube Standard license and a Creative Commons license where in its use by others it must be obtain prior permission from the Copyright Holder or Creator. While efforts to protect and resolve disputes have also been regulated under the Copyright Act, in addition YouTube is set forth in its policy also has set out the efforts in protecting the video as a copyright object and the way of settlement of disputes, although the manner of dispute resolution in YouTube has not been accommodate the needs of users as legal subjects.
