Abstract
Pada skripsi ini dilatar belakangi bahwa Berdasarkan Peraturan Pemerintah Nomor 53 Tahun 2010 tentang Disiplin Pegawai Negeri Sipil Pasal 10 ayat 9 huruf (d) menyatakan bahwa “Pemberhentian dengan hormat tidak atas permintaan sendiri atau pemberhentian tidak dengan hormat sebagai PNS yang tidak masuk kerja tanpa alas an yang sah selama 46 (empat puluh enam) hari kerja atau lebih”. Ini membuktikkan bahwa Pejabat Pembina Kepegawaian di BKD Kabupaten Lamongan sudah dapat menerbitkan surat keputusan pemberhentian tanpa memerlukan waktu sampai 10 tahun dan tidak memerlukan kehadiran PNS tersebut. Karena Pejabat Pembina Kepegawaian sudah diberikan kewenangan untuk memeriksa dan menindak seorang PNS yang melakukan pelanggaran disiplin. Akan Tetapi, pada kenyataannya saat ini ada kasus dimana seorang PNS ini sudah melakukan pelanggaran pada tahun 2004 dimana pada saat diberi sanksi penundaan kenaikan pangkat selama 1 (satu) tahun. Namun setelah ada sanksi tersebut PNS ini menghilang sampai pada tahun 2005 ada sanksi yang diberikan yaitu penetapan pemberhentian pembayaran gaji. Sampai pada tahun 2015 adanya program e-pupns dimana semua PNS wajib untuk melakukan pemutakhiran database kepegawaian beliau yang bersangkutan tidak melakukan program itu. Hingga akhirnya pada tahun 2017 yang bersangkutan mendatangi Kantor BKD Kabupaten Lamongan untuk meminta hak-hak kepegawaiannya selama ini yang dirasa statusnya merasa terkatung-katung. Pada akhirnya PNS tersebut mengajukan banding ke BAPEK hingga saat ini belum ada keputusan mengenai kasus ini.
English Abstract
In this thesis grounded by Government Regulation No. 53 of 2010 on Civil Service Discipline Article 10 paragraph 9 letter (d) states that "Dismissal with respect not on request alone or dismissal not with respect as civil servants who do not come to work without the love that valid for 46 (forty six) working days or more ". This proves that Officers Officer in BKDS of Lamongan Regency can already issue an unconditional termination letter for up to 10 years and does not demand the civil servant. Because the Officer Civil Service has been given the authority to be examined and crack down a civil servant who perform negligence discipline. Akansel, at this time there is a case where a civil servant is already doing the process in 2004 which at the time of being given additional sanctions promotion for 1 (one) year. However, after there are sanctions that these civil servants are distinguished until the year 2005 there are sanctions given the determination of the dismissal of salary payments. Until 2015 the existence of e-pupns program where all civil servants are required to update the database of personnel who do not do the program. Until finally in the year 2017 concerned visited the Office of BKD Lamongan District to ask for his employment rights so far felt perceived status. In the end, the civil servant appealed to BAPEK until now there has been no decision on this case.
