Abstract
Penelitian ini bertujuan untuk mengetahui penerapan Pasal 8 Ayat (1) Huruf J Undang-Undang No. 8 Tahun 1999 tentang Perlindungan Konsumen terkait peredaran produk makanan ringan impor tanpa label berbahasa Indonesia di Kota Malang. Dalam Pasal 8 Ayat (1) Huruf J Undang-Undang No. 8 Tahun 1999 tentang Perlindungan Konsumen menjelaskan bahwa Pelaku usaha dilarang memproduksi dan/atau memperdagangkan barang dan/atau jasa yang tidak mencantumkan informasi dan/atau petunjuk penggunaan barang dalam bahasa Indonesia sesuai dengan ketentuan perundang-undangan yang berlaku. Penelitian ini dibuat untuk meningkatkan perlindungan terhadap konsumen dari pelaku usaha yang mengedarkan produk makanan ringan impor tanpa label berbahasa Indonesia tersebut. Jenis penelitian ini adalah jenis penelitian yuridis empiris dengan metode pendekatan yuridis sosiologis yang dilakukan dengan cara penelitian langsung untuk memperoleh data dan informasi terkait penerapan Pasal 8 Ayat (1) Huruf J Undang-Undang No. 8 Tahun 1999 tentang Perlindungan Konsumen. Berdasarkan hasil penelitian ini dapat diketahui bahwa penerapan Pasal 8 Ayat (1) Huruf J Undang-Undang No. 8 Tahun 1999 tentang Perlindungan Konsumen tidak dapat diterapkan secara efektif dikarenakan terhambat oleh beberapa faktor seperti, peralihan kewenangan Dinas Perdagangan Kota ke Dinas Perdagangan Provinsi, kurangnya sosialisasi yang dilakukan oleh Dinas Perdagangan Kota Malang
English Abstract
This research aims to understand the implementation of Article 8, Paragraph (1), Letter j of the Law No. 8 Year 1999 on Consumer Protection related to the distribution of imported snack product without Indonesian language label in Malang City. In Article 8, Paragraph (1), Letter j of the Law No. 8 of 1999 on Consumer Protection explains that business actors are prohibited to produce and/ or trade goods and/or services that do not include information and/or instructions on the use of goods in the Indonesian language, in accordance with the provisions of applicable legislation. This research was conducted to improve the protection of consumers from business actors who distribute imported snack products without the Indonesian language label. This type of research is empirical legal research using sociological jurisprudence approach method by direct research to obtain data and information related to the implementation of Article 8, Paragraph (1), Letter j of the Law Number 8 Year 1999 on Consumer Protection. Based on the results of this research can be seen that the implementation of Article 8, Paragraph (1), Letter j of the Law Number 8 Year 1999 on Consumer Protection cannot be applied effectively because it is hampered by several factors such as, the transition of authority of the City Trade Service to the Provincial Trade Service, the lack of socialization conducted by the Trade Service of Malang City.
