Abstract
Pada Tesis ini, penulis mengangkat masalah tentang alih fungsi lahan hutan lindung kawasan tumpang pitu Kabupaten Banyuwangi. Pilihan tersebut dilatar belakangi oleh timbulnya bencana banjir pasca alih fungsi lahan hutan lindung. Karena pengalih fungsian lahan memiliki sayarat-syarat yang diatur oleh Undang-undang dan jika syarat tersebut tidak terpenuhi maka secara hukum mengandung kecacatan dan secara lingkungan akan menimbulkan dampak bencana. Berdasarkan latar belakang tersebut diatas, Tesis ini mengangkat rumusan masalah: (1) Bagaimana keabsahan surat keputusan Menteri Kehutanan Nomor : 826/Menhut-II/2013 tentang alih fungsi kawasan hutan Tumpang Pitu seluas 1946 Ha ditinjau dari Peraturan Perundang-Undangan terkait dengan perlindungan dan pengelolaan lingkungan hidup? (2) Bagaimana akibat hukum Surat Keputusan Menteri Kehutanan Nomor : 826/Menhut-II/2013 tentang alih fungsi kawasan hutan Tumpang Pitu yang mengandung cacat yuridis selama belum ada putusan pembatalan oleh Pengadilan Tata Usaha Negara? Penulisan Tesis ini menggunakan jenis pernelitian yuridis normatif dengan metode pendekatan perundang-undangan dan metode pendekatan konsep. Penelitian ini menggunakan bahan hukum primer dan sekunder. Dari hasil penelitian menggunakan metode diatas, penulis mendapatkan jawaban bahwa SK Nomor 826/Menhut-II/2013 mengandung kecacatan yuridis yang telah diuji keabsahannya berdasarkan Undang-undang Nomor 5 Tahun 1986 tentang Peradilan Tata Usaha Negara karena secara substansi melanggar beberapa Undang- vi undang, yaitu Undang-undang Nomor 41 Tahun 1999 tentang Kehutanan, Undang-undang Nomor 26 Tahun 2007 tentang Penataan Ruang, Undang-undang Nomor 4 Tahun 2009 tentang Pertambangan Mineral dan Batu Bara, juga Undang-undang nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolan Lingkungan Hidup.
English Abstract
On this thesis, author raised the issue of functional changes of protected forest Tumpang Pitu in Regency of Banyuwangi Area. The choice, backed by the emergence of flood disasterspost-conversion of protected forest land. Because the land transfer function hasconditionswhich is governed by lawand if such conditions are not metthen legally contain defects and environmentally will cause disaster. Based on the background above,this thesis raised the problem formulation: (1) How is the validity of the decreeMinister of Forestry Number: 827/Menhut-II/2013 about over function of forest area Tumpang Pitu covering an area of 1946 Ha in terms of Legislationrelated to protection and management of the environment? (2) How the legal consequencesDecree of the Minister of Forestry Number: 826/Menhut-II/2013 about over function of forest area Tumpang Pituwhich contains juridical defectsas long as there is no decision on cancellationby the State Administrative Court? The writing of this thesis uses normative research typewith the method of legislation approach and concept approach method. This research usesprimary and secondary law. viii From the research using the above method, author get answersthat Decree number 826/Menhut-II/2013 contains juridical defectswhich has been tested for its validityunder the Constitution number 5, 1986 about the State Administrative Courtbecause it substantially violates several laws, Constitution number 4, 2009 about Mineral and Coal Mining, also Constitution number 32, 2009 about Environmental Protection and Management.
