Abstract
Setiap subjek hukum yakni individu maupun korporasi yang bermasalah dengan hukum, dalam arti bahwa apa yang telah dilakukan atau memilih untuk tidak dilakukan adalah berbenturan dengan suatu ketentuan pidana, akan dihadapkan kepada suatu mekanisme penegakan hukum. Mekanisme ini diatur dalam ketentuan pidana formil atau yang kita kenal sebagai KUHAP. Aturan KUHAP yang masih bersifat umum dan mendasar dijalankan dengan aturan Perkap No 14 tahun 2012 tentang Manajemen Penyidikan Tindak Pidana sebagai aturan teknisnya. Terdapat perbedaan pengaturan antara aturan KUHAP dan Perkap dalam hal penentuan dasar yuridis penahanan dalam suatu penyidikan. Hal tersebut dikarenakan kerancuan yang ada dalam rumusan KUHAP pasal 21 ayat 1 sebagai syarat subjektif penahanan dimana aturan Perkap memiliki rumusan yang berbeda serta makna dan implikasi yang berbeda pula secara hukum. Untuk memahami apa yang diinginkan oleh para pembuat KUHAP serta kesesuaiannya dengan aturan Perkap, penelitian dilakukan terhadap urgensi digantinya aturan HIR sebagai pendahulu KUHAP serta analisa terhadap pendapat akhir yang disampaikan para fraksi dalam masa perumusan sampai kepada pengesahan KUHAP sebagai pengganti HIR. Perbedaan rumusan dalam aturan HIR dan KUHAP serta urgensi dari digantinya aturan HIR ke dalam aturan KUHAP merupakan latar belakang yang digunakan dalam menganalisa kesesuaian antara aturan Perkap sebagai aturan pelaksana KUHAP.
English Abstract
Any legal subject of an individual or corporation that is in conflict with the law, in the sense that what has been done or chose not to do is to clash with a criminal provision, will be faced with a law enforcement mechanism. This mechanism is regulated in a formal criminal provision or known to us as a Criminal Procedure Code (KUHAP). The KUHAP rules that are still general and fundamental are carried out with the Chief of Police Regulation No. 14 of 2012 on Criminal Investigation Management (Perkap) as a technical rule. There is a difference of arrangement between KUHAP and Perkap rules in determining the juridical basis of detention in an investigation. This is because the confusion in the formulation of KUHAP article 21 paragraph 1 as a subjective condition of detention where the rules of Perkap have different formulas and the meaning and implications of different law. In order to understand what KUHAP wanted and its compliance with the Perkap rule, the research was conducted on the urgency of the replacement of HIR rules as the predecessor of KUHAP and the analysis of the final opinion submitted by the factions in the formulation period until the ratification of KUHAP as a substitute for HIR. The difference in formulation in the HIR and KUHAP rules and the urgency of the replacement of the HIR rules into KUHAP rules is the background used in analyzing the suitability between the rules of the Perkap as the implementing rule of KUHAP.
