Abstract
Pada skripsi ini, penulis mengangkat permasalahan hukum dalam hal perlindungan hukum pengetahuan tradisional sebagai kekayaan bangsa dalam perspektif hak kekayaan intelektual. Penelitian ini dilatarbelakangi karena banyak pengetahuan tradisional di Indonesia yang digunakan tanpa adanya izin oleh pihak-pihak yang tidak bertanggung jawab, hal ini dikarenakan belum adanya instrument hukum di Indonesia yang mengatur secara keseluruhan terkait pengetahuan tradisional. Penelitian ini bertujuan untuk melakukan analisis terhadap rezim hak kekayaan intelektual diantaranya hukum Paten dan hukum Perlindungan Varietas Tanaman dan juga upaya pemerintah dalam melakukan perlindungan pengetahuan tradisional, khususnya pengetahuan tradisional yang digunakan tanpa izin oleh pihak asing (Misappropriation). Metode yang digunakan dalam penelitian ini adalah metode pendekatan yuridis normatif, yang memfokuskan pada studi literatur dan perundang-undangan dengan spesifikasi penelitian deskriptif analisis dan diintrepretasikan dengan metode intrepretasi gramatikal. Hasil dari penelitian menunjukan bahwa pengetahuan tradisional di Indonesia masih kurang mendapatkan perlindungan hukum. Jika ditinjau dari rezim hukum paten dan hukum perlindungan varietas tanaman akan terlihat beberapa kekurangan seperti tidak terpenuhinya syarat-syarat subtantif dari Paten dan PVT yaitu novelty, inventive step, dan industrially applicable. Perlunya upaya alternatif yang harus dilakukan oleh pemerintah untuk melindungi pengetahuan tradisional di Indonesia, seperti pembentukan undang-undang yang bersifat sui generis, menerapkan mekanisme benefit sharing, dan juga melakukan defensive protection seperti pendokumentasian pengetahuan tradisional.
English Abstract
In this research, the authors raised the legal issues in terms of protection of traditional knowledge law as a nation's wealth in the perspective of intellectual property rights. This research is motivated because a lot of traditional knowledge in Indonesia is used without permission by irresponsible parties, this is because there is no legal instrument in Indonesia that regulates overall related to traditional knowledge. The purpose of this research is to analyze the intellectual property rights regime and the efforts by the government in the protection of traditional knowledge, especially the traditional knowledge that used without permission. The method used in this research was normative-juridical, which is focused on literary studies and Laws in which descriptive analysis and grammatical interpretation were applied in the research. It is concluded based on the research result that there is a lack of protection given to traditional knowledge of Indonesia. Seen from the regime of patent law and the law of plant varieties protection, substantive requirement regarding the patent and PVT such as novelty, inventive step, and industrial application is not yet fulfilled. It is considered essential that the government take some alternative measures in order to protect traditional knowledge in Indonesia, such as forming a Law which is sui generis, implementing benefit sharing mechanism, and defensive protection which involves documenting traditional knowledge.
