Abstract
Pada skripsi ini, penulis mengangkat permasalahan Implementasi Pasal 1 ayat 25 Peraturan Presiden Nomor 4 Tahun 2015 tentang Pengadaan Barang dan Jasa Khusus Barang Kendaraan Roda Empat, penulis melakukan penelitian di Bank Pembangunan Daerah Jawa Barat dan Banten. Pemilihan tema tersebut didasarkan pada pengadaan yang dilakukan oleh Bank Pembangunan Daerah Jawa Barat dan Banten, yaitu mengenai pelelangan sederhana berdasarkan yang diatur dalam Pasal 1 ayat 25 Peraturan Presiden Nomor 4 Tahun 2015 mengenai Pelelangan Sederhana. Berdasarkan penjelasan diatas, karya tulis ini mengambil rumusan masalah: (1) Bagaimana Implementasi Pasal 1 ayat 25 Peraturan Pemerintah Nomor 4 Tahun 2015 tentang Pengadaan Barang dan Jasa khusus Barang kendaraan roda empat yang berkenaan dengan pelelangan sederhana pengadaan barang atau jasa di Bank Pembangunan Daerah Jawa Barat dan Banten ? (2) Bagaimana hambatan dan solusi dalam pemilihan penyedia pengadaan barang dan jasa khususnya kendaraan roda empat di Bank Pembangunan Daerah Jawa Barat dan Banten ? Selanjutnya, penulisan karyailmiah ini menggunakan jenis penelitian empiris dengan menggunakan metode pendekatan yuridis sosiologis. Terdapat dua jenis xii data yang digunakan oleh penulis yaitu data primer dan data sekunder. Selanjutnya, data yang diperoleh akan diolah dengan mengunakan teknik deskriptif kualitatif. Teknik deskriptif kualitatif adalah suatu metode mengenai cara penulisan dengan terlebih dahulu mengumpulkan data. Kemudian, penulis melakukan analisis data untuk mengetahui mengenai permasalahan yang dikaji oleh penulis sehingga dari data tersebut dapat diartikan sebagai fakta informasi yang diperoleh dari aktivitas serta tempat yang menjadi subjek dari penelitian yang dilakukan oleh penulis. Dari hasil penelitian dengan menggunakan metode tersebut, penulis memperoleh jawaban tentang permasalahan yang ada bahwa telah melaksanaan Pasal 1 ayat (25) Peraturan Presiden Nomor 4 Tahun 2015 tentang Pengadaan Barang dan Jasa khusus Barang Kendaraan Roda Empat dengan baik. Meskipun Bank Pembangunan Daerah Jawa Barat dan Banten memiliki pedoman tersendiri dalam proses pengadaan barang dan jasa, yaitu dalam Surat Keputusan Direksi Nomor: 0573/SK/DIR-UM/2016 pada 29 Juni 2016. Namun, Bank Pembangunan Daerah Jawa Barat dan Banten tetap condong pada Peraturan Presiden Nomor 4 Tahun 2015 Tentang Pelaksanaan Pengadaan Barang dan Jasa sehingga penerapan Pasal 1 ayat (25) sudah berjalan dengan baik dan optimal. Dalam kegiatan pengadaan barang dan jasa, Bank Pembangunan Daerah Jawa Barat dan Banten masih menemukan adanya penyelewengan waktu mengenai pengadaan barang dan jasa sehingga hal tersebut sangat merugikan dikarenakan sebelumnya telah adanya kesepakatan oleh kedua belah pihak. Maka dari itu, Bank Pembangunan Daerah Jawa Barat dan Banten melakukan upaya untuk mengatasi hambatan tersebut dengan cara memberikan peringatan teguran, peringatan tertulis pada daftar hitam xiii (Blacklist) sehingga pihak - pihak yang masuk ke dalam daftar hitam tersebut tidak boleh mengikuti proses pelelangan di Bank Pembangunan Daerah Jawa Barat dan Banten selang waktu kurang lebih selama 2 (dua) Tahun.
English Abstract
In this passage, the author raises the issues of Implementation of Article 1, Paragraph 25 Presidential Decree No. 4 of 2015 on Procurement of Goods Vehicle Specials Four Wheel, the author conducted research in the Regional Development Bank of West Java and Banten. Selection is based on the theme of procurement conducted by the Regional Development Bank of West Java and Banten, which is about the simple auction based set forth in Article 1, Paragraph 25 Presidential Decree No. 4 of 2015 on Simplified Auctions. Based on explained above, this paper took the formulation of the problem: (1) How Implementation of Article 1, paragraph 25 of Government Regulation No. 4 of 2015 on Procurement of Goods and Special Services Goods Vehicle Four Wheel with respect to the tender the simple procurement of goods or services in Java Regional Development Bank Banten and west? (2) What barriers and solutions provider in the selection of goods and services, especially four-wheel vehicles in the Regional Development Bank of West Java and Banten? Furthermore, the writing of this paper using the type of empirical research and using sociological juridical approach. There are two types of data used by the xv author are primary data and secondary data. The acquired data will be processed by using qualitative descriptive technique. Technique qualitative description is a method of how to write by first collecting the data. Then, the authors analyze the data to find out about issues that were examined by the author so of these data can be interpreted as the fact the information obtained from the activity and place that is the subject of research conducted by the author. From the results of research using these methods, the authors obtain answers about the existing problems that have been carrying out Article 1 (25) Presidential Decree No. 4 of 2015 on Procurement of Goods Vehicle Four Wheel particular well. Although the Regional Development Bank of West Java and Banten has its own guidelines in the procurement of goods and services, namely the Board of Directors Decree No. 0573 / SK / DIR-UM / 2016 on June 29, 2016. However, the Regional Development Bank of West Java and Banten remain skewed on Presidential Decree No. 4 of 2015 on the implementation of Goods and Services so that the application of Article 1 (25) has been running well and optimally. In the procurement of goods and services, Regional Development Bank of West Java and Banten still found the time lapse on the procurement of goods and services so that it is very harmful because previously had an agreement by both parties. Therefore, the Regional Development Bank of West Java and Banten made efforts to overcome these barriers by providing a warning of reprimand and written on the blacklist so that the partcipants goes into the black list, it should not follow tender processes Development Bank West Java and Banten interval of less than 2 (two) years.
