Abstract
Pada Skripsi ini, penulis mengangkat permasalahan di Kabupaten Ponorogo menyangkut Kasus Kendaraan Dinas Operasional Anggota DPRD yang harus dikembalikan berkaitan dengan adanya Penerimaan Tunjangan Transportasi berdasarkan Pasal 27 Peraturan Daerah Kabupaten Ponorogo Nomor 5 Tahun 2017 tentang Hak Keuangan Administratif Pimpinan dan Anggota DPRD, bahwa Anggota DPRD disediakan dua pilihan yakni Jika sudah disediakan Kendaraan dinas operasional, maka Anggota DPRD Kabupaten Ponorogo tidak mempunyai hak atas Tunjangan Transportasi. Hal tersebut berlaku sebaliknya.Dalam kasus tersebut Anggota DPRD Ponorogo yang sudah menerima Tunjangan Transportasi Harus mengembalikan Kendaraan Dinas Operasional. Untuk Pimpinan DPRD tidak adanya keharusan pengembalian terkait kendaraan dinas yang diterima,karena Hak Protokoler yang melekat pada jabatan Pimpinan DPRD Ponorogo tersebut. Berdasarkan hal tersebut diatas, Rumusan Masalah dalam penelitian ini adalah (1) Apakah Pelaksanaan Pengembalian Kendaraan dinas operasional Anggota DPRD pasca diterimanya tunjangan transportasi sudah sesuai dengan Pasal 27 Peraturan Daerah Kabupaten Ponorogo Nomor 5 Tahun 2017 ? (2) Bagaimana Konsekuensi Hukum dari Pengembalian Kendaraan dinas operasional Anggota DPRD pasca diterimanya tunjangan transportasi terhadap Pasal 27 Peraturan Daerah Kabupaten Ponorogo Nomor 5 Tahun 2017 ? Kemudian penulisan karya tulis ini menggunakan Jenispenelitian Hukum Yuridis empiris, Metode pendekatan yang digunakan adalah yuridis sosiologis. Penelitian dilakukan di Sekretariat DPRD dan Badan Pendapatan Pengelolaan Keuangan dan Aset Daerah Kabupaten Ponorogo.Data Primer, Sekunder yang diperoleh penulis dianalisis dengan menggunakan teknik analisis Deskriptif analitis yaitu analisis data yang dipergunakan adalah pendekatan kualitatif terhadap data primer dan data sekunder. Dari hasil penelitian diketahui bahwa belum adanya kesesuaian antara kenyataan yang terjadi dilapangan dengan penerapan Pasal 27 Peraturan Daerah Kabupaten Ponorogo Nomor 5 Tahun 2017 tentang Hak Keuangan dan Administratif Pimpinan dan Anggota DPRD. bagi Anggota DPRD Pemberian Kendaraan Dinas harus segera dikembalikan kepada Pemerintah Daerah terkait adanya penerimaan Tunjangan Transportasi. Berdasarkan hal diatas sosialisasi akan Perda tersebut rupanya belum terlaksana dengan baik. Pengembalian kendaraan operasional tersebut mempunyai Konsekuensi hukum baik terhadap Anggota DPRD Kabupaten Ponorogo maupun status Kendaraan Dinas operasional Anggota DPRD Ponorogo. Status kendaraan dinas operasional yang sudah dikembalikan bukan lagi menjadi aset yang dapat dimanfaatkan dan digunakan berdasarkan tugas pokok dari SKPD (Satuan Kerja Perangkat Daerah) DPRD.Kendaraan Dinas Anggota DPRD yang sudah dikembalikan vi akan diserahkan dari SKPD di DPRD,kepada Sekretaris Daerah Kabupaten Ponorogo sbagai pengelola Barang.Untuk Kendaraan dinas operasional DPRD yang sifatnya tidak dapat dipergunakan lagi bagi pelaksana tugas di Pemerintah Daerah, maka status kemdaraan tersebut dapat dipindahtangankan.Kendaraan Dinas DPRD yang sifatnya telah rusak dan tidak dapat dipergunakan untuk kepentingan Daerah.Dengan kata lain,dapat dikatakan pemindahtanganan dalam bentuk Penjualan.Penjualan Barang Milik Daerah berupa Kendaraan Dinas dilaksanakan secara lelang.Kendaraan Dinas yang sudah dikembalikan statusnya, dapat dilakukan penjualan dengan dasar pertimbangan bahwa hal tersebut dapat menguntungkan bagi Pemerintah daerah jika ditinjau dari segi ekonomis. Selain itu penjualan barang tersebut, mengurangi beban biaya operasional dan pemeliharaan yang lebih besar dari manfaat yang diperoleh.
English Abstract
In this final report, the writer discussed about the problem in Ponorogo Regency related with the Operational Official Vehicle of RPRA Member, that the RPRA Member given two choices that is if given Operational Official Vehicle, then the RPRA members do not have right to get transportation allowance. It is prevail vice versa. In the case the member of RPRA of PonorogoRegency who had transportation allowance should bring back the operational official vehicles. For the RPRA leader no requirement for the operational official vehicles, because the protocol right attributed to the post of RPRA Leader of Ponorogo Regency. Based on the matter above, the problem formulation in the research is (1) do the return implementation of the operational official vehicle of RPRA member after the acceptance of the transportation allowance has suitable with the article 27 Local Regulation of Ponorogo Regency Number 5 Year 2017? (2) how the legal consequences of the return of operational official vehicles of RPRA member after the acceptance of transportation allowance toward article 27 Local regulation of Ponorogo Regency Number7 Year 2017? Then this writing using juridical empirical research, the approach used was sociological juridical approach. The research done at RPRA Secretariat and Office of Financial Management Income and Local Asset of PonorogoRegency. Primary, Secondary and tertiary data obtained then analyzed descriptively, that is qualitative approach for primary and secondary data. From the research it was known that no suitability between the fact occurred in field with the implementation of article 27 Local Regulation of Ponorogo Regency Number 5 Year 2017 about the Financial and Administrative Right of the Leaders and Members of RPRA. For the member of RPRA the giving of operational official vehicles should be brought back to the local government related to the acceptance of transportation allowance. Based on the matter above the socialization about the local regulation is not implemented well. The return of the operational official vehicles have legal consequences toward the members of RPRA of Ponorogo Regency or to the status of the operational official vehicles of the RPRA members of Ponorogo Regency. The status of operational official vehicles of RPRA member of Ponorogo regency that have been brought back not the asset that can be used based on the main task of Local Task Unit (LTU) of RPRA. The official vehicles that have been brought back will be delivered from LTU at RPRA, to the local secretary of Ponorogo Regency as the goods manager. For operational official vehicles of RPRA that can not be used again for the task implementer in the Local Government, then the vehicles status can be transferred. The RPRA Official vehicles that has damaged or can not be used for local interest, with other word can be transferred or sold. The sale of the operational official vehicles can be done in auction. The official vehicles whose status returned, can be sold with consideration that it will bring benefit for the Local Government if iv viewed from economic viewpoint. Beside that the sales of the goods, decrease the higher operational and maintenance costs if compared to the benefit accepted .
