Abstract
Pada penelitian ini, penulis mengangkat judul mengenai pilihan jenis jaminan sebagai pelaksanaan prinsip kehati-hatian dalam mengantisipasi kredit bermasalah di K-BPR Babadan Ponorogo. Pilihan judul tersebut dilatar belakangi karena prinsip kehati-hatian wajib dilakukan dalam setiap tahapan pemberian kredit pada K-BPR Babadan Ponorogo sebagaimana diatur dalam Pasal 8 Undang-Undang Nomor 10 Tahun 1998 tentang Perbankan. Salah satu syarat dalam pemberian kredit yaitu dengan adanya jaminan sebagai tambahan keyakinan bank dalam memberikan kredit, sehingga perlu diterapkan prinsip kehati-hatian pada saat memilih jaminan. Jaminan disini berupa benda bergerak yang diikat dengan jaminan fidusia, sedangkan jaminan benda tetap diikat dengan jaminan hak tanggungan. Penelitian ini dilakukan di K-BPR Babadan Ponorogo dikarenakan terdapat berbagai macam jenis jaminan yang digunakan dalam pemberian kredit, sehingga mengharuskan pihak bank untuk memilih jaminan apa yang efektif digunakan sebagai pelaksanaan prinsip kehati-hatian guna mengantisipasi terjadinya kredit bermasalah.
English Abstract
This research was initiated with the awareness that caution is needed in every step of loan provision in K-BPR Babadan Ponorogo, as regulated in Article 8 of Law Number 10 Year 1998 on Banking. One of the requirements in providing loan is an object put as a security to assure bank to grant the loan, so that customers need to be more careful in deciding the type of collateral. The collateral can be in the form of personal property bound by fiduciary guarantee or in the form of real property bound by mortgage right guarantee. The research was conducted in KBPR in Babadan Ponorogo since there are several kinds of collateral set as a security in giving loan to bank customers, so that it opens wider access for the bank to choosing which property is effective to be set as collateral. This is a cautious step the bank can do just in case of bad credit.
