Abstract
Penelitian ini membahas dan menganalisis perlindungan hukum terhadap korban kejahatan praktik money game bermodus bisnis Multi Level Marketing (selanjutnya disebut MLM). Keberadaan praktik money game yang di Indonesia pada umumnya bermodus bisnis MLM pada dasarnya menimbulkan kerugian bagi korban nya. Berdasarkan hal tersebut Penelitian ini dibuat untuk mengetahui bagaimana perlindungan hukum terhadap korban dari praktik money game. Melalui penggunaan metode penelitian yuridis empiris diperoleh kesimpulan bahwa pelaku praktik money game dapat dikategorikan sebagai tindak pidana yang diatur dalam Pasal 372, 374, 378 KUHP dan dapat dikenakan sanksi pidana yang teretera dalam Pasal 105 Undang-undang Nomor Nomor 7 Tahun 2014 tentang Perdagangan. Korban kejahatan praktik money game bermodus bisnis MLM dapat dikategorikan ke dalam participating victims. Bentuk Perlindungan hukum yang diberikan oleh kepolisian berupa pemberian informasi tentang perkembangan kasus terkait proses penyidikan dan pemeriksaan sedangkan untuk pemberian ganti rugi yang diderita korban bergantung pada putusan pengadilan. Bentuk perlindungan hukum yang diberikan oleh pemerintah adalah dengan mengenakan sanksi administratif kepada perusahaan berbasis MLM yang mengantongi SIUPL namun menerapkan praktik money game. Bentuk perlindungan hukum yang diberikan oleh Otoritas Jasa Keuangan lebih kepada bentuk preventif dimana dengan memberikan edukasi dan melakukan sosialisasi kepada masyarakat. Selain itu OJK juga membentuk Satgas Waspada Investasi.
English Abstract
This research discusses and analyzes about the legal protection for victims of money game practice covered by multilevel marketing business (hereinafter called as MLM). Generally, the existence of money games practice in Indonesia covered by MLM business basically causes loss for their victims. Based on that, this research was conducted to understand how the legal protection implement for victims of money game practice. Through the use of empirical legal research method, it can be concluded that a money game practitioner can be categorized as a criminal act as which is regulated in Article 372, 374, 378 of the Indonesian Penal Code and may be subjected to a criminal sanction that is reflected in Article 105 of the Law Number 7 Year 2014 on Trade. Victims of crime of the money game practices covered by MLM can be categorized into participating victims. The form of legal protection provided by polices, such as providing information on the development of cases related to the process of investigation and examination while for the provision of compensation suffered by victims depend on the court decision. The form of legal protection provided by the government is to impose administrative sanctions to companies based on MLM that have SIUPL, but applying a money game practice. The form of legal protection provided by the Financial Services Authority (Otoritas Jasa Keuangan/OJK) focuses on the preventive form by giving education and socialization to society. In addition, the Financial Services Authority has formed Task Force of Warning Investment (Satgas Waspada Investasi)
