Abstract
Dalam perkawinan tidak dipungkiri adanya putusnya perkawinan karena perceraian. Tetapi permasalahan tidak dapat diselesaikan jika kedua belah pihak tidak dapat menunjukan akta nikah dan sah suatu pernikahan. Untuk menghindari kejadian tersebut, maka masyarakat bisa mengajukan permohonan itsbat nikah. Namun masalah baru masih memungkinkan untuk timbul yakni menyangkut kedudukan harta bersama selama masa perkawinan yang tidak dicatatkan. Kasus kedudukan harta bersama sering menjadi masalah yang diperkarakan saat terjadi perceraian. Harta bersama adalah harta benda yang diperoleh selama masa perkawinan. Sementara itsbat nikah, status perkawinan baru diakui setelah dilakukannya perkawinan resmi yang dicatat oleh negara. Dalam kasus kedudukan harta bersama dalam itsbat nikah terdapat kekaburan hukum, sejak kapan diberlakukannya perhitungan harta bersama tidak dijelaskan dengan jelas baik dalam Undang - Undang Perkawinan maupun Kompilasi Hukum Islam. Tujuan penelitian ini adalah mencari tahu bagaimana kedududukan dan akibat hukum harta bersama pada perceraian sebelum dilakukannya itsbat nikah. Oleh karena itu penelitian ini menggunakan yuridis normatif dan pendekatan perundang-undangan. Untuk menghindari kesalahan pemahaman konsep dalam penelitian ini maka disusun batasan-batasan definisi konseptual terkait objek yang dikaji dalam penelitian ini yaitu perkawinan, itsbat nikah, harta bersama, dan perceraian. Dengan demikian melihat pentingnya pencatatan perkawinan, maka disarankan kepada masyarakat untuk lebih memperhatikan status perkawinan mereka terutama yang berstatus belum tercatat agar segera melakukan itsbat nikah. Selain itu, disarankan pula untuk memperjelas status harta bersama mereka untuk menghindari terjadinya sengketa di kemudian hari.
English Abstract
In marriage there is no denying the marriage breakup because of divorce. But the problem can not be solved if both parties can not show a marriage certificate and a marriage valid. To avoid such incidents, then people can apply for marriage marriage. But the new problem is still possible to arise which concerns the position of joint property during the unregistered marriage period. The case of a common property position often becomes a problem that is incurred during a divorce. Collective property is the property acquired during the marriage. While marriage marriage, marital status is only recognized after official marriage is recorded by the state. In the case of the position of joint property in the marriage marriage there is a vagueness of law, since when the enactment of the calculation of joint property is not clearly defined in both the Marriage Law and the Compilation of Islamic Law. The purpose of this study is to find out how the position and the legal consequences of joint property in divorce before the marriage isbat. Therefore, this study uses normative jurisdiction and legislation approach. To avoid misconceptions of concepts in this study, the boundaries of conceptual definitions related to the object studied in this study are marriage, marriage, marriage, joint property, and divorce. Thus see the importance of marriage recording, it is advisable to the public to pay more attention to their marital status, especially those who have not recorded status to immediately do marriage marriage. In addition, it is also advisable to clarify the status of their joint property to avoid future disputes.
