Abstract

Pada tesis ini penulis mengangkat permasalahan mengenai anak, khususnya mengenai prinsip non diskriminasi dalam ketentuan diversi bagi anak sebagai pelaku kekerasan seksual. Dimana terdapat konflik norma di dalam Undang-Undang Nomor 11 Tahun 2012 Tentang Sistem Peradilan Pidana Anak yaitu antara pasal 2 dengan pasal 7 ayat (2), yaitu mengenai pengaturan diversi yang dirasa penulis masih mengandung prinsip diskriminasi terhadap anak sebagai pelaku kekerasan seksual sehingga anak tidak diperbolehkan untuk melakukan diversi. Berdasarkan latar belakang diatas, penulis mengangkat rumusan masalah: (1) Apakah pengaturan diversi dalam UU SPPA sudah mencerminkan prinsip non diskriminasi bagi anak sebagai pelaku kekerasan seksual? (2) Bagaimana reformulasi hukum diversi dalam UU SPPA terhadap prinsip non diskriminasi bagi anak sebagai pelaku kekerasan seksual di masa yang akan datang? Penulisan tesis ini menggunakan penelitian hukum normatif dengan pendekatan perundang-undangan, pendekatan kasus. Dimana bahan hukum primer, sekunder dan tersier yang diperoleh penulis akan dianalisis dengan penafsiran gramatikal. Hasil penelitian dengan metode penelitian diatas, penulis memperoleh jawaban atas permasalahan yang ada. Pertama, bahwa diversi yang terdapat di dalam UU SPPA belum mencerminkan prinsip non diskriminasi dikarenakan terdapat pembatasan mengenai syarat anak melakukan diversi yaitu ancaman hukuman yang diterima anak tersebut tidak boleh diatas 7 tahun dan anak tersebut bukan merupakan residivis. Kedua, dengan melakukan perbandingan diversi antara negara Indonesia dengan The Beijing Rules, serta beberapa perbandingan agar pengaturan hukum mengenai diversi dapat mencerminak prinsip non diskriminasi, untuk kedepannya dapat diganti agar diversi dapat dilaksanakan dalam hal semua tindak pidana tanpa terkecuali.

English Abstract

In this thesis the authors raised the issue of children, especially regarding the principle of non-discrimination in the provision of diversion for children as perpetrators of sexual violence. Where there is a conflict of norms in Law Number 11 Year 2012 on the Criminal Justice System of Children, namely between Article 2 and Article 7 Paragraph (2), namely the arrangement of diversion that the writer still contains the principle of discrimination against children as perpetrators of sexual violence so that the child does not Allowed to do. Based on the above background, the authors raised the problem formulation: (1) Is the diversion arrangement in the Law Number 11 Year 2012 on the Criminal Justice System of Children already reflect the principle of non-discrimination for children as perpetrators of sexual violence? (2) How is the reformulation of the law diversion in the Law Number 11 Year 2012 on the Criminal Justice System of Children against non-discriminatory principles for children as perpetrators of future sexual violence? This thesis research uses normative legal research with approach of legislation, case approach. Where the primary, secondary and tertiary legal material obtained by the author will be analyzed by grammatical interpretation. Result of research above, writer get answer to existing problem. Firstly, that the diversion contained in the Law Number 11 Year 2012 on the Criminal Justice System of Children does not reflect the principle of non-discrimination because there is a limitation on the child's requirement of having a version of the punishment received by the child should not be above 7 years and the child is not a recidivist. Secondly, by comparing the diversion between Indonesia and The Beijing Rules, as well as some comparisons so that the legal arrangements on diversion may reflect the principle of non-discrimination, in the future it can be replaced in order that diversion can be carried out in all cases of crime without exception.
