Abstract
Tesis ini bertujuan untuk mengkaji tentang Apakah Besarnya Ganti Kerugian Negara Menjadi Pertimbangan Hakim Dalam Menjatuhkan Pidana Penjara Dalam Putusan Nomor : 1050 K/Pid.Sus/2014 dan Bagaimana pertimbangan hakim dalam menentukan pidana penjara pengganti apabila terpidana tidak dapat mengganti kerugian yang telah ditetapkan jenis penelitian hukum normatif berupa penelitian kepustakaan yang menggunakan 3 bahan hukum yaitu bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier . kemudian dibantu dengan dengan bahan-bahan hukum yang akan diuraikan, dideskripsikan, dan dianalisis keterkaitan satu sama lain. Hasil penelitian Kerugian Negara/Desa adalah kekurangan uang, surat berharga, dan barang, yang nyata dan pasti jumlahnya sebagai akibat perbuatan melawan hukum baik sengaja maupun lalai”. Menurut BPK kerugian harus terjadi secara riil dan nyata, sehingga dapat disimpulkan bahwa BPK menganut delik formil dan materiil karena frasa “dapat” tidak berlaku berlaku untuk BPK. BPK menyatakan adanya kerugian pada Negara hanya apabila kerugian telah nyata dan pasti dapat dihitung Pertimbangan Hakim Dalam Menentukan Pidana Penjara Pengganti yaitu kebebasan hakim dalam melaksanakan kekuasaan kehakiman yaitu Hakim hanya tunduk pada hukum dan keadilan, Tidak seorangpun termasuk pemerintah dapat mempengaruhi atau mengarahkan putusan yang akan dijatuhkan oleh hakim, Tidak ada konsekuensi terhadap pribadi hakim dalam menjalankan tugas dan fungsi yudisialnya
English Abstract
This thesis aims to examine the question of whether the magnitude of compensation of the state is the judge's consideration in the imposition of imprisonment in the verdict Number 1050 K / Pid.Sus / 2014 and how the judge judges in determining the imprisonment of the prison if the convicted person can not indemnify type of normative legal research in the form of library research using 3 legal materials that are primary legal materials, secondary law materials and tertiary legal materials. then assisted with the legal materials to be described, described, and analyzed in relation to each other. BPK states that there is a loss to the State only if the loss is real and it can be calculated Judge Consideration in Determining Replacement of Replacement Prison ie judicial freedom in exercising judicial power ie Judge only subject to law and justice, No one including government can influence or direct judgment which will be imposed by judge, There is no consequence to personal judges in performing their duties and judicial functions
