Abstract
Pada penelitian ini, penulis mengangkat permasalahan wujud perlindungan hukum bagi peserta PT Taspen terhadap kewajiban pengalihan jaminan pensiun PT Taspen kepada BPJS Ketenagakerjaan. Pilihan tema ini dilatar belakangi oleh adanya perintah untuk PT Taspen dalam hal mengalihkan program yang sedang mereka jalankan kepada BPJS Ketenagakerjaan sebelum tahun 2029. Perintah transformasi itu didasari oleh Undang-Undang SJSN yang mengisyarakatkan bahwa seluruh program jaminan nasional hanya boleh dijalankan oleh BPJS Kesehatan dan BPJS Ketenagakerjaan. Penelitian ini menggunakan metode yuridis normatif dengan metode pendekatan perundang-undangan. Berdasarkan hasil penelitian dan pembahasan, dapat ditarik kesimpulan bahwa pengalihan program PT Taspen kepada BPJS Ketenagkerjaan akan melahirkan perlindungan hukum bagi peserta PT Taspen terkait dengan kepastian hukum dalam hal mekanisme klaim.
English Abstract
In this research, the author raised the issue concerning to the form of legal protection for the members of PT Taspen on the obligation of diversion of pension assurance from PT Taspen to the Indonesian Employment Social Security Agency. This chosen theme is motivated by the existence of the order for PT Taspen in terms of diversion on the program that they are running to the Indonesian Employment Social Security Agency before year 2029. The order of diversion is regulated by the Law on National Social Security System which requires that all the national assurance programs may only be administered by the Indonesian Health Social Security Agency (BPJS Kesehatan) and the Indonesian Employment Social Security Agency (BPJS Ketenagakerjaan). This research uses normative legal method with statute approach method. Based on the results of the research and discussion, it can be concluded that the diversion program of PT Taspen to the Indonesian Employment Social Security Agency will bring legal protection for members of PT Taspen related to the legal certainty in terms of claim mechanism.
