Abstract
Pada skripsi ini penulis meneliti mengenai proses pengadaan tanah skala kecil yang dilakukan oleh pihak pemkot Surabaya dalam melakukan pembebasan lahan bundaran dolog di Surabaya. Penelitian ini dilatarbelakangi karena adanya inkonsistensi isi peraturan antara undang-undang dengan peraturan pelaksanaannya berupa pengaturan mengenai penetapan lokasi dalam proses pengadaan tanah dihilangkan didalam pengaturan pelaksananya, dimana dijelaskan dalam UU No.2 Tahun 2012 tentang Pengadaan Tanah Bagi Pembangunan Untuk Kepentingan Umum, menyebutkan bahwa dalam setiap proses pengadaan tanah harus memohonkan penetapan lokasi, namun didalam Perpres No.148 tahun 2015 yang menjelaskan lebih spesifik mengenai pengadaan tanah skala kecil tidak mewajibkan penetapan lokasi harus dilakukan oleh instansi yang memerlukan tanah. Namun, jika dikaitkan dalam praktek lapangan, pengadaan tanah skala kecil ini dilakukan oleh pemkot Surabaya dimana salah satu proyek mengusahakan pembebasan lahan di bundaran dolog guna kepentingan umum yaitu sebagai RTH dan pelebaran jalan. Rumusan masalah dalam penelitian ini berupa: (1). Bagaimana pelaksanaan pembebasan lahan untuk pengadaan tanah skala kecil setelah diberlakukannya Perpres No.148 tahun 2015? (2). Apa hambatan yang dialami oleh pemerintah kota Surabaya dalam pelaksanaan pembebasan lahan di area bundaran dolog serta bagaimana solusi untuk menyelesaikan pembebasan lahan tersebut?. Metode penelitian ini memakai metode yuridis empiris dengan metode pendekatan yuridis sosiologis, yang menggunakan teknik content analysis untuk menganalisa sumber data yang ada dilapangan dengan metode analisis deskriptif kualitatif yang mendeskripsikan data dilapangan kemudian di analisis disesuaikan dengan peraturan yang ada. Hasil penelitian mengenai rumusan pelaksanaan pengadaan tanah yang dilakukan diproyek pemkot kota Surabaya yaitu: (1). pembebasan lahan bundaran dolog masih mengutamakan penggunaan penetapan lokasi dimana pihak pemkot telah memohonkan Surat Keputusan Penetapan Lokasi kepada Gubernur Jawa Timur No. 188/247/KPTS/013/2016 yang dikeluarkan pada tanggal 4 April 2016 yang menetapkan penetapan lokasi bagi pelaksanaan pengadaan tanah di kawasan Bundaran Dolog tersebut agar dapat dijadikan sebagai alas hak pembebasan lahan yang ditunjukkan kepada masyarakat. (2). hambatan yang terjadi selama proses pembebasan lahan terdiri dari (a) tidak adanya anggaran yang dikhususkan untuk pelaksanaan pengadaan tanah khusus area Bundaran Dolog, (b) masyarakat yang masih belum menerima tawaran harga dari appraisal dikarenakan harga yang ditawarkan berada di bawah harga NJOP dan (c) bukti kepemilikan yang masih beragam dan solusi penyelesaiannya berupa: (1) tidak mengalihkan anggaran yang telah disiapkan, (2) tim appraisal dapat lebih memberikan penjelasan kepada warga akan faktor yang mempengaruhi nilai tanah mereka serta (3) seharusnya kepemilikan tanah berupa SHM guna memudahkan kepengurusan.
English Abstract
In this thesis, the author researching about small-scale land procurement process conducted by the Government of Surabaya in conducting land acquisition dolog roundabout in Surabaya. The study was backed by the inconsistencies between the regulation of the content of the legislation with the rules of its implementation in the form of arrangements regarding the determination of the location is in the process of acquiring the land eliminated in the Organization settings, which are described in Undang-Undang No. 2 in 2012 about the procurement of Land for development for the benefit of the public , mentions that in any procurement process ground should pray for the determination of the location, however in the Perpres No. 148 2015 that describes more specific regarding the procurement of small scale land does not require the determination of the location should be carried out by establishments that require the land. However, if linked in practice field, this small scale land procurement conducted by the Government of Surabaya where one project is aiming at the acquisition of land in the public interest to dolog roundabout that is as RTH and road widening. Formulation of the problem in this study include: (1) How the implementation of land acquisition for the procurement of small scale land after the enactment of Perpres No. 148 2015? (2) What barriers experienced by the Government of the city of Surabaya in the execution of the acquisition of land in the area roundabout dologand how a solution to resolve the land acquisition? This research method of empirical juridical method with the juridical sociological approach method, which uses the technique of content analysis to analyze existing data source field with a descriptive qualitative methods of analysis that describes the data in field later in the analysis adapted to the existing regulations. The results of the research on the formulation of the implementation procurement ground is done by the Government of Surabaya are: (1) the acquisition of land still preferring the use of dolog roundabout assignment location where party Government has pleaded with the decision letter of Assignment to the Governor of East Java No. 188/247/KPTS/013/2016 issued on April 4 , 2016 which establishes the setting location for the implementation of the provision of land in the area to be the Dolog Roundabout was used as the base land acquisition rights are shown to the public. (2) the obstacles that occur during the process of land acquisition consists of (a) the absence of a budget that is devoted to the implementation of specific land procurement area Roundabout Dolog, (b) community who still haven't received an offer price of yangditawarkan price due to the appraisal is below the price of NJOP and (c) proof of ownership is still diverse and complete solutions in the form of : (1) does not transfer budget has been prepared, (2) appraisal team can better provide an explanation to the citizens will be the factors that affect the value of their land as well as (3) should the ownership the soil in the form of SHM in order to facilitate management.
