Abstract

Di tahun 2014, Rusia terlibat dalam permasalaan internal Ukraina dengan memberikan bantuan berupa pasokan persenjataan dan terntara ke kelompok Separatis yang berada di Ukraina Timur dan konflik tereskalasi menjadi konflik bersenjata antara Pemerintah Ukraina dan kelompok Separatis yang didukung oleh Rusia. Kemudian, dibuatlah perjanjian gencatan senjata bernama Minsk Agreements yang ditandatangani oleh Ukraina, Rusia, OSCE dan perwakilan kelompok Separatis yang kemudian gagal untuk menghentikan konflik karena tidak adanya kepatuhan untuk mengimplementasi. Rusia tetap memberikan bantuan berupa tentara dan persenjataan kepada kelompok Separatis. Akibat tindakannya, Rusia mendapatkan kecaman dari Barat dalam bentuk sanksi internasional. Penelitian ini akan melihat alasan dari ketidakpatuhan Rusia dalam mengimplementasi Minsk Agreements dengan dianalisis menggunakan compliance-based theory milik Andrew T. Guzman yang melihat alasan ketidakpatuhan karena keuntungan dari reputational loss yang kecil dan direct sanction yang tidak efektif. Dari penelitian ini ditemukan bahwa alasan Rusia adalah dikarenakan Reputational loss kecil akibat ketidakjelasan dalam Minsk Agreements dan Direct Sanctions yang diterima oleh Rusia tidak efektif.

English Abstract

ABSTRACT Russia's non-compliance against the implementation of Minsk Agreements in 2014-2015 In 2014, Russia was involved in Ukraine's internal conflict, between Government and Separatist Groups from Eastern Ukraina. Russia backed the Separatist Group by sending troops and military weapons and equipments. The conflict escalated into an armed-conflict between Ukraine's Government and Russia's backed Separatist. As a solution to the conflict, Ukraine, Russia, OSCE and leaders of Separatist group signed a peace agreement named Minsk Agreements and the agreements failed to give peace in Ukraine's territory as Russia failed to comply to implement the agreement by sending troops and not withdrawing the military equipments and weapons from Ukraine's territory that is controlled by Separatist groups after the agreements were signed. Because of its agression in Eastern Ukraine, Russia got international sanctions by West. This research will explain the reasons of Russia's non-compliance behavior against Minsk Agreements. To analyze the reason, this research used Andrew T. Guzman's compliance-based theory that explained the reason of violation against an agreement is because the high benefit/payoff that a country gets from violation because of the small reputational loss and the ineffectiveness of direct sanctions. As a result from the analysis, Russia's reputational loss is small in one indicator, which is, the clarity of international obligation and the direct sanctions that is imposed by Western countries are also ineffective to give pressures to Russia.
