Abstract
Salah satu daerah industrialisasi di Negara Indonesia yaitu Kabupaten Gresik yang telah memiliki total 461 (empat ratus enam puluh satu) jumlah industri besar dan sedang. Adanya pembangunan industri maka mampu meningkatkan perekonomian, namun juga memiliki dampak negatif yaitu adanya limbah industri yang secara langsung maupun tidak langsungdapat membahayakan lingkungan hidup, manusia, maupun makhluk hidup lainnya. Limbah B3 (bahan berbahaya dan beracun) merupakan salah satu limbah yang paling berbahaya karena mengandung bahan polutan yang memiliki karakteristik yaitu mudah meledak, mudah menyala, reaktif, infeksius, korosif, dan beracun, sehingga memerlukan perlakuan khusus dalam pengelolaannya. Perbup Gresik Nomor 52 Tahun 2013 yang ada sebagai kebijakan untuk mengatur tentang pengelolaan dan pengawasan limbah B3 di Kabupaten Gresik. Kebijakan tersebut tentu harus dapat diimplementasikan dengan baik dan benar kepada pihak-pihak terkait yaitu pihak industri dan masyarakat. Pihak industri seperti PT. Kelola Mina Laut merupakan perusahaan yang bergerak dibidang makanan, dimana perusahaan tersebut juga menghasilkan limbah B3. Sedangkan pihak masyarakat disini adalah aktivis lingkungan atau lembaga masyarakat yang peduli dan pemerhati lingkungan seperti lembaga swadaya masyarakat Ecoton. Hasil penelitian yang telah dilakukan menunjukkan bahwa kebijakan tata laksana pengelolaan dan pengawasan limbah B3 telah diimplementasikan oleh Dinas Lingkungan Hidup Kabupaten Gresik. Akan tetapi dalam proses implementasi masih terdapat kekurangan-kekurangan, yaitu: pada pengelolaanya yakni kegiatan pengumpulan limbah B3 jarang sekali dilakukan pada skala Kabupaten, dan pada pengawasannya yakni masih lemah karena masih sering ditemukan pembuangan limbah secara sembarangan. Selain itu penelitian dengan teori Edward III bahwa: a) Komunikasi kurang baik dari pemerintahan kepada masyarakat, b) dukungan anggaran dan fasilitas yang masih terbatas, c) Komitmen kurang baik, karena program kerja belum maksimaldan pemberian sanksi yang kurang tegas, d) struktur birokrasi yang perlu diubah untuk lebih memperhatikan kepada pihak ketiga atau transporter. Adapun dari faktor internal yaitu payung hukum sudah berjalan sangat baik, sedangkan anggaran masih terbatas. Sementara faktor eksternal yaitu pihak industri telah mematuhi peraturan yang telah ditetapkan, sedangkan masyarakat kurang percaya terhadap kebijakan yang dibuat oleh pemerintah sehingga keputusan masyarakat yang tidak sejalan menyebabkan implementasi suatu kebijakan kurang berjalan dengan baik.
English Abstract
One area of industrialization in the State of Indonesia is Gresik Regency which has a total of 461 (four hundred and sixty one) number of large and medium industries. The existence of industrial development is able to improve the economy, but also has a negative impact that is the industrial waste that directly or indirectly can endanger the environment, humans, and other living things. B3 waste (hazardous and toxic) is one of the most dangerous wastes because it contains pollutants that have the characteristics of being explosive, flammable, reactive, infectious, corrosive, and toxic, requiring special treatment in their management. Perbup Gresik No. 52 of 2013 which exists as a policy to regulate the management and supervision of B3 waste in Gresik Regency. The policy should certainly be implemented properly and correctly to the relevant parties, namely the industry and the community. Industry parties such as PT. Kelola Mina Laut is a company engaged in food, where the company also produces B3 waste. While the community here is an environmental activist or community agencies who care and environmentalists such as non-governmental organizations Ecoton. The results of the research have shown that the policy of management and supervision of B3 waste has been implemented by Gresik Regency Environmental Office. However, in the implementation process there are still deficiencies, namely: the management of the collection of B3 waste is rarely done on the scale of the District, and the supervision is still weak because it is still often found waste disposal in random. In addition, research with Edward III theory that: a) poor communication from government to society, b) budget support and limited facilities, c) poor commitment, because the work program is not maximized and the sanction is not firm, d) bureaucracy that needs to be changed to pay more attention to third parties or transporters. As for the internal factors of the umbrella law is already running very well, while the budget is still limited. While external factors that the industrial parties have complied with the rules that have been set, while the people lack of confidence in the policies made by the government so that people's decisions that are not in line cause the implementation of a policy is not running well.
