Abstract
Perkembangan informasi menjadi semakin canggih sehingga menimbulkan dampak negatif adalah berkembangnya tindak pidana dalam mendapatkan paspor di kantor Imigrasi Kelas I Kota Malang, beberapa waktu yang lalu telah terjadi tindak pidana pemalsuan identitas dalam mendapatkan paspor dengan tersangka bernama Ngatini dan AniMusfiroh. Berdasarkan latar belakang penelitian, dirumuskanlah 2 (dua) rumusan masalah yaitu tentang Bagaimana penyidikan tindak pidana pemalsuan identitas dalam mendapatkan paspor oleh Penyidik Pegawai Negeri Sipil Imigrasi Kelas I Kota Malang dan mengetahui alasan Penyidik Pegawai Negeri Sipil Imigrasi tidak memperbolehkan pengurusanpaspor untuk selamanya bagi Ngatini dan AniMusfiroh. Penelitian ini menggunakan jenis penelitian hukum metode yuridisempiris dengan pendekatan yuridis sosiologis. Data primer diperoleh menggunakan metode wawancara dengan Penyidik Pegawai Negeri Sipil Imigrasi Kelas I Kota Malang serta menggunakan teknik pengumpulan data purposive sampling. Data sekunder penelitian diperoleh melalui dokumentasi, penelusuraninternet ,penelusuranperaturan perundang-undangan,mencatat.Data primer dan data sekunder dianalisis dengan menggunakan metode deskriptif kualitatif. Hasil penelitian diperoleh bahwa, proses penyidikan yang dilakukan PPNS Imigrasi Kelas I Kota Malang adalah Pembuatan Surat Perintah Penyidikan, Pembuatan Surat Perintah Tugas, Pembuatan Surat dimulainya Penyidikan, Melakukan Pemanggilan terhadap saksi dan tersangka, Melakukan Pemeriksaan terhadap saksi dan tersangka, Melakukan penyitaan dokumen persyaratan pembuatan paspor yang dimiliki tersangka. Alasan PPNS Imigrasi Malang tidak menerapkan sanksi karena tersangka hanyalah korban dari calo yang tidak bertanggung jawab.Dalam kenyataannya tersangka telah memberikan data yang tidak sah atau keterangan yang tidak benar untuk memperoleh paspor bagi anak dan keponakannya yang ingin ke luar negeri untuk bekerja tetapi masih dibawah umur sehingga Penyidik Pegawai Negeri Sipil Imigrasi Kelas I Kota Malang menerapkan sanksi berupa tidak boleh membuat paspor selamanya.Sebaiknya pihak Penyidik Pegawai Negeri Sipil Imigrasi Kelas I Kota Malang tetap melanjutkan penyidikan sesuai yang telah diatur di dalam undang-undang dan menerapkan sanksi dalam pasal 126 Huruf C Undang-Undang Nomor 6 Tahun 2011.
English Abstract
The advance of information development had been confronted with its negative impact in relation with the crime in obtaining passport at First-Class Immigration Office for Malang City. Recent identity forgery crime in obtaining passport had been accusing Ngatini and Ani Musfiroh as the suspect. In relative to this background, two problems were formulated. First question was “How the investigation on identity forgery crime in obtaining passport is done by the Civil-Servant Investigator of First-Class Immigration Office for Malang City”. Second question was “What is the reason why the Civil-Servant Investigator of First-Class Immigration Office prohibits from registering passport for both suspects Ngatini and Ani Musfiroh”. Research type was law research. Method of research was empirical juridical with sociological juridical approach. Primary data were collected from the result of interview with the Civil-Servant Investigator of First-Class Immigration Office for Malang City. Sampling technique used purposive sampling. Secondary data were derived from documentation, internet exploration, rules and laws investigation, and note taking. Both primary and secondary data were analyzed using qualitative descriptive method. Result of research gave some indications. The Civil-Servant Investigator of First-Class Immigration Office for Malang City would initiate the investigation by releasing Letter of Investigation Order, Letter of Assignment Order, and Letter of Executing Investigation. The Investigator may also took actions such as summoning witness and suspect, examining witness and suspect, and seizing passport-related documents owned by the suspect. The reason why the Investigator did not apply legal sanction was because both suspects Ngatini and Ani Musfiroh were only victims of irresponsible brokerage. However, both suspects intentionally gave false data or improper information in obtaining passport for other person, in this case, for daughter and niece, whose age still below the legal age for working abroad. This action was condemned as violating the law, and the Civil-Servant Investigator of First-Class Immigration for Malang City then applied legal sanction by prohibiting them from registering for passport for their lifetime. However, it was suggested thatthe Civil-Servant Investigator of First-Class Immigration for Malang City should conduct the investigation in pursuance with legislation and carry over the sanction stated in Article 126 Letter C in Law No.6/2011.
