Abstract
Di antara aturan hukum Islam yang berorientasi kepada kemaslahatan adalah aturan tentang pembagian harta waris, dimana sebagian besar umat Islam meyakini bahwa sistem kewarisan yang selama ini diatur di dalam fiqih mawaris mengandung nilai keadilan dan kemaslahatan yang pasti dan dapat dipertanggungjawabkan. Sehingga anggapan yang selama ini diyakini adalah dengan menerapkan hukum waris menurut hukum waris Islam dianggap akan dapat mewujudkan kemaslahatan dalam kehidupan umat manusia. Among the rules of Islamic Law which oriented to the benefit is the rule of distribution of inheritance, where most of the Muslims believe that the system of inheritance that has been arranged in the fiqih mawaris contains the value of justice and the benefits that can be responsible.
