Abstract
Pada skripsi ini, penulis mengangkat permasalahan mengenai Pelaksanaan Pasal 5 Peraturan Desa Kemlagi Nomor 3 Tahun 2015 tentang Pembentukan dan Pengelolaan Badan Usaha Milik Desa (BUMDES). Pemilihan tema tersebut dilatarbelakangi karena adanya ketidakefektifan pelaksanaan kegiatan-kegiatan Badan Usaha Milik Desa (BUMDES) Desa Kemlagi, Kegiatan-kegiatan yang seharusnya dilaksanakan oleh Badan Usaha Milik Desa (BUMDES) Desa Kemlagi sebagaimana tercantum dalam Peraturan Desa Kemlagi Nomor 3 Tahun 2015 tersebut tidak dilaksanakan seluruhnya, sehingga hal tersebut dapat mempengaruhi pelaksanaan Pasal 5 Peraturan Desa Kemlagi Nomor 3 Tahun 2015 dan hal tersebut mengakibatkan maksud dan tujuan didirikannya Badan Usaha Milik Desa (BUMDES) Desa Kemlagi tidak dapat terwujud secara efektif dan optimal. Berdasarkan hal tersebut diatas, karya tulis ini mengangkat rumusan masalah: (1) Bagaimana pelaksanaan Pasal 5 Peraturan Desa Kemlagi Nomor 3 Tahun 2015 oleh Badan Usaha Milik Desa (BUMDES)?, (2) Apa kendala yang dihadapi oleh Badan Usaha Milik Desa (BUMDES) dalam melaksanakan kegiatan di Desa Kemlagi Kabupaten Mojokerto?, (3) Apa saja upaya yang dilakukan oleh Badan Usaha Milik Desa (BUMDES) Desa Kemlagi Kabupaten Mojokerto untuk mencapai maksud dan tujuan dalam Pasal 5 Peraturan Desa Kemlagi Nomor 3 Tahun 2015?. Jenis penelitian ini menggunakan metode yuridis sosiologis. Data primer diperoleh dari hasil wawancara, observasi, maupun dokumentasi sedangkan data sekunder diperoleh dari studi kepustakaan, dokumen-dokumen, media internet serta peraturan perundang-undangan yang berhubungan dengan permasalahan yang dibahas. Teknik analisis data yang digunakan adalah deskriptif analisis. Dari hasil penelitian yang dilakukan, penulis memperoleh jawaban bahwa dalam pelaksanaan Pasal 5 Peraturan Desa Kemlagi Nomor 3 Tahun 2015 belum efektif dan belum dapat terwujud secara optimal, hal ini dipengaruhi karena adanya kendala-kendala yang dihadapi oleh Badan Usaha Milik Desa (BUMDES) Desa Kemlagi yaitu kendala internal maupun kendala eksternal, namun dalam penelitian ini penulis juga memberikan upaya-upaya yang seharusnya dilakukan oleh Badan Usaha Milik Desa (BUMDES) Desa Kemlagi untuk menanggulangi kendala-kendala tersebut.
English Abstract
In this thesis, the author raised concerns about implementation of Article 5 of Village Kemlagi No. 3 of 2015 on the Establishment and Management of village-owned enterprises (BUMDES). Selection of the theme is motivated because of the ineffectiveness of the implementation of the activities of village-owned enterprises (BUMDES) Village Kemlagi, activities that should be implemented by the village-owned enterprises (BUMDES) Village Kemlagi as stated in Rule Village Kemlagi No. 3 of 2015 are not executed entirely, so that it can influence the implementation of Article 5 of Village Kemlagi No. 3 of 2015 and it resulted in the intent and purpose of the establishment of village-owned enterprises (BUMDES) Kemlagi village can not be done effectively and optimally. Based on the above, this paper raised the formulation of the problem: (1) How is the implementation of Article 5 of Village Kemlagi No. 3 of 2015 by the village-owned enterprises (BUMDES) ?, (2) What are the constraints faced by the village-owned enterprises (BUMDES ) in carrying out the activities in the village Kemlagi Mojokerto Regency ?, (3) What are the efforts made by the village-owned enterprises (BUMDES) Village Kemlagi Mojokerto to achieve the objectives in Article 5 of Regulation Kemlagi Village Number 3 Year 2015 ?. This research uses a sociological juridical methods. The primary data obtained from interviews, observation, and documentation while secondary data obtained from the study of literature, documents, internet media and legislation related to the issues discussed. Data analysis technique used is descriptive analysis. From the research conducted, the author answers that in the implementation of Article 5 of Village Kemlagi No. 3 of 2015 is not yet effective and have not been able to be realized optimally, it is affected because of the constraints faced by the village-owned enterprises (BUMDES) Village Kemlagi ie internal constraints and external constraints, but in this study the authors also provide efforts should be done by the village-owned enterprises (BUMDES) Village Kemlagi to overcome these constraints.
