Abstract
Penelitian ini bertujuan untuk mengetahui bagaimana penerapan sanksi administrasi pasal 44 Peraturan Menteri Kehutanan nomor P.31/Menhut-II/2012 tentang Lembaga Konservasi. Dalam pasal 44 tersebut mengatur tentang sanksi administrasi bagi setiap pemegang izin lembaga konservasi untuk kepentingan umum yang melanggar ketentuan yang dimaksud dalam pasal 29 dan pasal 30 ayat (2). Di Kota Surabaya masih banyak ditemui lembaga konservasi yang terindikasi melakukan pelanggaran. Penerapan pasal 44 Peraturan Menteri Kehutan Nomor P.31/Menhut-II/2012 ini bertujuan untuk pengelolaan lembaga konservasi dilakukan berdasarkan prinsip etika dan kesejahteraan satwa serta dalam hal pengembangbiakan terkontrol untuk menyelamatkan tumbuhan dan satwa dengan tetap mempertahankan kemurnian jenisnya. Apabila peraturan ini tidak diterapkan maka setiap tahun akan muncul pelanggaran-pelanggaran yang terjadi di lembaga konservasi untuk kepentingan umum di Kota Surabaya. Berdasarkan hal tersebut, Skripsi ini mengangkat dua rumusan masalah, yaitu: Bagaimana penerapan sanksi administrasi Pasal 44 dalam Peraturan Menteri Kehutanan Nomor P.31/Menhut-II/2012 tentang Lembaga Konservasi. Apa hambatan dan bagaimana solusi pelaksanaan penerapan sanksi administrasi Pasal 44 dalam Peraturan Menteri Kehutanan Nomor P.31/Menhut-II/2012 tentang Lembaga Konservasi. Adapun jenis penelitian yang digunakan penulis adalah jenis penelitian empiris dengan metode penelitian Yuridis Sosiologis yang dilakukan dengan cara penelitian langsung untuk memperoleh data mengenai penerapan sanksi administrasi pasal 44 Peraturan Menteri Kehutanan Nomor P.31/Menhut-II/2012 Tentang Lembaga Konservasi. Metode pengambilan data dilakukan dengan cara studi di lapangan dengan melakukan wawancara kepada Pegawai Balai Besar Konservasi Sumber Daya Alam Jawa Timur, dan Mahasiswa Fakultas Kedokteran Hewan Universitas Brawijaya. Berdasarkan hasil penelitian ini maka dapat diketahui bahwa penerapan sanksi administrasi pasal 44 Peraturan Menteri Kehutanan Nomor P.31/Menhut-II/2012 terhadap pelanggaran yang terjadi di lembaga konservasi untuk kepentingan umum yang belum diterapkan secara efektif karena terhambat oleh beberapa faktor seperti faktor kematian satwa yang disebabkan karena usia satwa yang memasuki masa tua, dan disebabkan oleh pernyakit, masih adanya pengunjung yang memberi makan satwa dan membuang sampah sembarangan padahal sudah ada larangan di lembaga konservasi, serta materi muatan substаnsiаl Perаturаn Menteri Kehutаnаn Nomor P.31/Menhut-II/2012 tentang Lembaga Konservasi.
English Abstract
This study aims to find out how the implementation of administrative sanctions article 44 Minister of Forestry Regulation number P.31/Menhut-II/2012 on Conservation Institution. In article 44 it regulates administrative sanctions for each conservation institute consent holder for public interest that violates the provisions referred to in Article 29 and Article 30 paragraph (2). In Surabaya there are still many conservation institutions that are indicated to have committed violations. The application of article 44 of this Ministerial Regulation of the Minister of Forestry Number P.31/Menhut-II/2012 aims to manage conservation institutions based on ethical principles and animal welfare and in the case of controlled breeding to save plants and animals while maintaining its purity. If this regulation is not implemented then every year there will be violations occurring in the conservation institution for the public interest in Surabaya. Based on this matter, this thesis raised two problem formulation, namely: How the implementation of administrative sanction Article 44 in Regulation of Minister of Forestry Number P.31/Menhut-II/2012 about Conservation Institution. What are the obstacles and how the solution of implementation of administrative sanction implementation Article 44 in the Minister of Forestry Regulation Number P.31/Menhut-II/2012 on Conservation Institution. The type of research used by the author is the type of empirical research with research method of Sociological Juridical done by direct research to obtain data about the implementation of administrative sanction article 44 Minister of Forestry Regulation Number P.31/Menhut-II/2012 About Conservation Institution. Method of data retrieval is done by way of study in field by conducting interview to East Java Natural Resource Conservation Center, and Student of Faculty of Veterinary Medicine Universitas Brawijaya. Based on the result of this research, it can be seen that the implementation of administrative sanction article 44 of the Minister of Forestry Regulation Number P.31/Menhut-II/2012 on violations occurring in the conservation institution for the public interest that has not been applied effectively because it is hampered by several factors such as animal death factor which is caused by the age of the animal entering old age, and caused by pernyakit, there are still visitors who feed animals and littering when there is already a ban on conservation agencies, as well as material content substituents Permanent Minister of Forestry Number P.31/Menhut-II/2012 on Conservation Institutions.
