Abstract

Dalam skripsi ini peneliti membahas mengenai masalah penegakan sanski administrasi terhadap pencemaran Lingkungan berupa pembuangan limbah ke Sungai Wangi Kabupaten Pasuruan yang dilakukan oleh perusahaan bernama PT. CS2 Pola Sehat, perusahaan tersebut memproduksi minuman kemasan yang kita kenal dengan Teh Gelas, permasalahan penegakan sanksi inilah yang diangakat oleh peneliti untuk ditinjau keefektifan sanksi tersebut. Dalam penelitian ini menggunakan metode yuridis sosiologis, yang mendasarkan penelitian pada peraturan dan perundang-undangan yang berlaku dan juga dikaitkan dengan kenyataan yang terjadi sebenarnya dilapangan. Peneliti menggunakan data primer yang didapat melalui wawancara dan data sekunder yang di dapat melalui studi kepustakaan. Berdasarkan hasil penelitian yang dilakukan, peneliti melakukan penelitian dengan melakukan wawancara dengan instansi terkait yaitu Dinas Lingkungan Hidup serta melakukan wawancara dengan masyarakat disekitar aliran sungai wangi, peneliti juga melakukan pengambilan gambar mengenai kondisi terkini sungai wangi, dengan tindakan-tindakan tersebut peneliti menemukan beberapa fakta yaitu, bahwa kegiatan pencemaran masih terjadi dan pemberian sanksi berupa teguran tertulis dirasa belum memberikan dampak yang signifikan. Hambatan yang terjadi yang mengakibatkan kurang maksimalnya penegakan sanksi yaitu, kurang memadahinya fasilitas pengelohan limbah atau IPAL (Instalasi Pengolahan Air Limbah) yang dimiliki pabrik serta minimnya sumber daya manusia di lingkup Dinas Lingkungan Hidup sehingga lemahnya xvi pengawasan, sehingga Dinas Lingkungan Hidup kesulitan mencari bukti untuk dijadikan dasar memberikan sanksi lanjutan. Adapun saran yang diberikan peneliti yaitu, diharapkan Dinas Lingkunga Hidup agar lebih pro aktif dengan menjadi mediator antara PT. CS2 Pola Sehat dengan perusahaan induk agar diberika fasilitas IPAL yang memadahi, saran kedua yaitu agar dilakukan penambahan jumlah sumber daya manusia di lingkup Dinas Lingkungan Hidup, selain itu juga peningkatan kualitas setiap pegawai Dinas Lingkungan Hidup.

English Abstract

In this thesis discusses about the problem of enforcement of administrative sanski to pollution of environmental waste to river Wangi Pasuruan conducted by company named PT. CS2 Pola Sehat, a company that produces beverage packaging that we are familiar with Teh Gelas, law enforcement issues that are accepted by researchers to review the effectiveness of such sanctions. In this study using sociological juridical method, which based on research on the rules and legislation applicable and also associated with reality that actually happened in the field. Researchers use primary data obtained through interviews and secondary data in the can through literature study. Based on the results of research conducted, the researchers conducted a study by conducting interviews with relevant agencies of the Environment Agency and conducting interviews with the community around the fragrant river flow, researchers also did a picture of the current condition of the fragrant river, with these actions researchers found some facts , that the pollution activity is still happening and sanction in the form of written warning is not yet have a significant impact. The obstacles that resulted in the lack of maximum enforcement of sanctions are less waste of waste disposal facilities or WWTP (Waste Water Treatment Plant) owned by the factory and the lack of human resources within the scope of the Environment Service so that the lack of supervision, so that the Office of the Environment difficulties to find evidence to be made basis provides further sanctions. As for the advice given by the researcher is, it is expected the Lingkunga Life Service to be more pro active by becoming mediator between PT. CS2 Healthy Pattern with the parent company to be given the IPAL facilities that overflow, the second suggestion is to make the addition of the number of human resources in the scope of the Environment Agency, but also the quality improvement of every employee of the Office of the Environment.
