Abstract
Kecamatan Waingapu, Kabupaten Sumpa Timur terdapat suatu fenomena menarik untuk dibahas yaitu penerbitan surat akta kelahiran yang diterbitkan oleh Dinas Kependudukan dan Pencatatan Sipil. Persyaratan dan tata cara pendaftaran penduduk dan pencatatan sipil yang telah dilakukan oleh Dispendukcapil tidak sesuai dengan Pasal 52 ayat 1 Peraturan Presiden Republik Indonesia Nomor 52 Tahun 2008 tentang Syarat-syarat Penerbitan Akta Kelahiran. Permasalahan yang akan dibahas yaitu efektivitas pelaksanaan pasal 52 ayat 1 Peraturan Presiden Nomor 25 Tahun 2008 dan upaya yang dilakukan oleh Dispendukcapil agar penerbitan akta kelahiran di Kecamatan Waingapu berjalan efektif. Penelitian ini menggunakan metode yuridis empiris yang digunakan untuk menelaah keefektivan penerbitan akta kelahiran di Kecamatan Waingapu Kabupaten Sumba Timur yang tidak sesuai dengan peraturan yang berlaku. Berdasarkan penelitian yang telah dilakukan, dapat ditarik kesimpulan bahwa dalam pelaksanaan pasal 52 ayat 1 Peraturan Presiden Nomor 25 Tahun 2008 tentang syarat-syarat penerbitan akta kelahiran oleh Dinas Kependudukan dan Pencatatan Sipil Kecamatan Waingapu, Kabupaten Sumba Timur dikatakan tidak berjalan efektif.
English Abstract
Waingapu subdistrict, East Sumba district there is an interesting phenomenon to be discussed that is the establishment of the certificate of birth published by Population and Civil Registration Agency (Dispendukcapil). The requirement and the procedure of registration that had been done by Dispendukcapil is not accordance with the article 52 paragraph 1 the Presidential Regulation of Republic Indonesia number 52 year 2008 about the requirements of establishment of birth certificate. The problem that will be discussed is the effectivity of implementation of article 52 paragraph 1 the presidential regulation number 25 year 2008 and the effort that will be done by Dispendukcapil in order that the establishment of birth certificate in Waingapu subdistrict can run effectively. This research uses empirical juridical method that is used to study the effectivity of the establishment of birth certificate in Waingapu subdistrict East Sumba district that is not in line with the rule that is implemented. Based on the research that had been done, it can be concluded that in the implementation of the article 52 paragraph 1 the Presidential Regulation Number 25 Year 2008 about requirements of establishment of the birth certificate by Population and Civil Registration Agency of Waingapu subdistrict East Sumba district cannot run effectively.
