Abstract
Pada skripsi ini, penulis mengangkat permasalahan kekaburan norma terhadap perlindungan karakter fiksi dan grafis Disney yang digunakan dalam bentuk merhandise. Pemilihan tema tersebut dilatar belakangi dengan masih banyak beredarnya penggunaan karakter fiksi dan grafis disney pada merchandise tanpa adanya izin pencipta. Berdasarkan hal tersebut diatas, karya tulis ini mengangkat rumusan masalah : bagaimana perlindungan hukum pemegang Hak Cipta atas karakter Disney yang digunakan pada barang dagang? dan apa upaya hukum pencipta dalam melindungi Hak Ekonomi atas karya cipta fiksi dan grafis Disney? Kemudian jenis penulisan karya tulis ini menggunakan metode yuridis normatif dengan metode pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Bahan hukum primer dan sekunder diperoleh penulis akan dianalisis dengan menggunakan interpretasi gramatikal yakni penafsiran yang digunakan untuk mengetahui makna ketentuan undang-undang dengan menguraikannya menurut bahasa, susunan kata atau bunyinya, sehingga jelas makna dan maksud perundang-undangan yang ditafsirkan; serta penafsiran ekstensif yakni penafsiran dengan cara memperluas arti kata yang terdapat pada undang-undang sehingga suatu peristiwa dapat dimasukan kedalamnya. Dari hasil penelitian dengan metode diatas, penulis memperoleh jawaban permasalahan yang ada bahwa upaya pencipta dalam melindungi hak cipta dan hak desain industri khusunya penggunaan karakter fiksi dan grafis disney maka produsen yang ingin menggunakan karakter fiksi dan grafis disney memerlukan adanya lisensi terlebih dahulu. Karena dilindungi oleh perlindungan hukum preventif dan perlindungan represif. Apabila ada produsen yang tidak menggunakan lisensi maka pencipta dapat mengajukan upaya hukum yang terdiri dari litigasi dan non litigasi.
English Abstract
In this thesis, the authors raised the problem of the obscurity of the norm against the protection of fictional characters and Disney graphics used in the form of merhandise. The selection of the theme is in the background with many circulation of fictional characters and disney graphics on merchandise without the creator's permission. Based on the above, this paper raises the problem formulation: what is the legal protection of the copyright holder for the Disney character used on merchandise? And what is the legal effort of the creator in protecting the Economic Right over Disney's fictional and graphic works? Then the type of writing of this paper using normative juridical methods with statutory approach (statute approach) and conceptual approach (conceptual approach). The primary and secondary legal material obtained by the author will be analyzed by using grammatical interpretation ie the interpretation used to know the meaning of the provisions of the law by describing it according to the language, wording or sound, so that clearly the meaning and purpose of the legislation is interpreted; As well as the extensive interpretation of interpretation by extending the meaning of words contained in the law so that an event can be entered into it. From the results of research with the above method, the authors obtained the answer to the existing problems that the efforts of the creator in protecting copyright and industrial design rights especially the use of fiction and disney graphics then manufacturers who want to use fiction and disney graphics require the existence of a license first. Because it is protected by preventive legal protection and repressive protection. If any manufacturer does not use the license then the creator may file a legal effort consisting of litigation and non litigation.
