Abstract
Penelitian ini bertujuan untuk mengetahui penggunaan mesin printer 3D ditinjau berdasarkan pasal 9 dan pasal 46 Undang-Undang Nomor 28 tahun 2014 tentang Hak Cipta terkait dengan tindakan penggandaan, dimana jika melihat dalam rumusan pasal 9 ayat 1 huruf b Undang-Undang Nomor 28 tahun 2014 tentang Hak Cipta disebutkan bahwa tindakan penggandaan merupakan salah satu bagian dari hak eksklusif yang dimiliki oleh pencipta atau pemegang hak cipta. Tindakan penggandaan sendiri secara khusus merupakan bagian dari hak ekonomi yang dimiliki oleh pencipta, sehingga terdapat batasan yang harus dicermati oleh setiap orang. Penelitian ini dibuat untuk mengetahui tentang keabsahan penggunaan mesin printer 3D terkait dengan aturan dalam Undang-Undang Hak Cipta. Adapun jenis penelitian ini adalah jenis penelitian normatif dengan metode penelitian Yuridis normatif yang dilakukan dengan cara penelitian melalui Undang-Undang serta teori-teori yang berkembang terkait dengan analisis penggunaan mesin printer 3D ditinjau berdasarkan pasal 9 dan pasal 46 Undang-Undang Nomor 28 tahun 2014 tentang Hak Cipta yang menyangkut tindakan penggandaan. Berdasarkan hasil penelitian ini maka dapat diketahui bahwa keabsahan penggunaan alat ini dapat dilakukan selama bukan untuk tujuan komersil dan penggunaannya sesuai dengan aturan yang diberlakukan oleh produsen atau penyedia desain serta tidak melanggar ketentuan dalam UUHC. Apabila muncul suatu sengketa dalam penggunaan mesin printer 3D maka perlindungan hukum atas hak eksklusif dari pencipta maupun pemegang hak cipta terkait tindakan penggandaan menggunakan mesin printer 3D dapat dilakukan dengan dua metode perlindungan hukum yaitu perlindungan preventif (mencegah) dan represif (mengatasi).

This research aims to find out the use of 3D printer machine is reviewed on the basis of article 9 and article 46 of the Act Number 28 years 2014 on copyright related to the This study aims to determine the use of 3D printer machines reviewed in accordance with Article 9 and Article 46 of Law No. 28 of 2014 on Copyrights related to duplication, which, if seen in the formulation of Article 9 paragraph 1 sub-paragraph b of Law No. 28 of 2014 Copyright is mentioned that duplication is part of an exclusive right owned by the creator or copyright holder. The act of doubling itself is specifically part of the economic rights owned by the creator, so there are limits to be observed by everyone. This study was made to find out about the validity of the use of 3D printer machines related to the rules in the Copyright Act. The type of this research is the type of normative research with normative juridical research methods conducted by research through the Act as well as the theories that developed related to the analysis of the use of 3D printer machines reviewed in accordance with Article 9 and Article 46 of Law No. 28 of 2014 Copyrights concerning duplication. Based on the results of this study it can be seen that the validity of the use of this tool can be done as long as not for commercial purposes and its use in accordance with the rules imposed by manufacturers or design providers and does not violate the provisions in UUHC. If a dispute arises in the use of a 3D printer machine then the legal protection of the exclusive rights of the creator or copyright holder in relation to duplicate actions using a 3D printer machine can be done by two methods of legal protection ie preventive (repressive) and repressive (overcoming) protection.
