Abstract
Saksi memiliki peran sangat penting dalam mengungkap suatu tindak pidana, khususnya dalam kerangka mencari kebenaran materiil dari suatu perbuatan yang terindikasi sebagai tindak pidana. Saksi diharapkan dapat memberikan keterangan secara terbuka tanpa adanya ancaman dan/atau intimidasi yang dilakukan oleh tersangka maupun keluarga tersangka atau orang suruhan tersangka yang ingin mempengaruhi keterangan saksi. Posisi saksi sangat rentan dan lemah terhadap gangguan yang mengancam pribadi, keluarga maupun harta bendanya, oleh karena itu perlindungan hukum seakan menjadi kewajiban yang harus diberikan oleh setiap lembaga penegak hukum khususnya lembaga kejaksaan negeri terhadap saksi demi membantu proses pemeriksaan untuk mengungkap suatu perkara tindak pidana korupsi. Tulisan ini akan membahas tentang peran lembaga kejaksaan negeri dalam hal pemberian perlindungan hukum terhadap saksi tindak pidana korupsi.
English Abstract
Witness has a very important role to uncover a criminal offense, particularly in terms of seeking the material truth of an act that is indicated as a crime act. The witness is expected to testify without any threat and / or intimidation by the suspect or the suspect's family or agents of suspects who want to influence witness testimony. The position of the witness is vulnerable and weak by disruptions which threaten their personal, family and personal belongings. Therefore the protection of the law as an obligation that must be provided by any law enforcement agency specialized institutions in the state judiciary for witnesses to help the investigation process to uncover a corruption case. This paper will discuss about the role of the state judiciary institutions in terms of providing legal protection to witnesses of corruption.
