Abstract
Nasionalisasi yang dilakukan oleh suatu negara menjadi hal yang menakutkan bagi para investor dan memunculkan suatu sengketa. Venezuela pada tahun 2011, dibawah kepemimpinan Presiden Hugo Chavez telah menasionalisasi kontrak tambang emas Las Cristinas yang dimiliki investor asal Kanada, yaitu perusahaan Crystallex International. Kontrak tersebut diakhiri secara sepihak atau unilaterally dan tanpa pemberian kompensasi apapun. Nasionalisasi tersebut turut melibatkan perjanjian investasi bilateral (BIT) antara Venezuela dengan Kanada, yaitu pada pasal II dan pasal VII tentang perlindungan investasi dan ekspropiasi. Tindakan tersebut dinilai oleh Crystallex telah mencerminkan ketidakpatuhan dan melanggar pasal dalam perjanjian tersebut serta merugikan Crystallex sebagai investor atas modal yang telah ditanamkan. Kasus tersebut diselesaikan melalui lembaga arbitrase internasional milik Bank Dunia, yaitu ICSID (International Centre for Settlement of Investment Disputes). Penulis menggunakan teori yang dikenalkan oleh Andrew T. Guzman, yaitu Compliance Based Theory untuk menganalisis kasus ketidakpatuhan Venezuela terhadap Bilateral Investment Treaty (BIT) dengan Kanada pada kasus nasionalisasi kontrak tambang emas Las Cristinas milik perusahaan Crystallex International dari Tahun 2011-2016.Teori tersebut memiliki dua variabel, yaitu sanksi reputasi dan sanksi langsung beserta indikator yang dapat menjelaskan suatu negara untuk memilih patuh atau tidak patuh terhadap hukum internasional. Berdasarkan variabel dan indikator tersebut, penulis akan fokus menganalisis penyebab ketidakpatuhan Venezuela tersebut dengan melihat besar kecilnya dari masing-masing sanksi yang diperoleh Venezuela sebagai negara pelanggar.
English Abstract
The nationalization conducted by a country becomes frightening to investors and raises a dispute. Venezuela in 2011, under the leadership of President Hugo Chavez, has nationalized gold mining contract, owned by the Canadian Investors Crystallex International company. The Contract has been terminated unilaterally and without any compensation. The nationalization involved Bilateral Investment Agreements (BIT) between Venezuela and Canada, namely Article II and Article VII on investment protection and expropriation. Such actions were assessed by Crystallex reflecting as non-compliance and breaching the articles on that agreement and harming Crystallex as an investor for invested capitals. The case was resolved through the international arbitration institution owned by the World Bank, namely ICSID (International Center for Settlements of Investment Disputes). the author will use the theory introduced by Andrew T. Guzman, named Compliance Based Theory to analyze the case of Venezuela's non-compliance to Bilateral Investment Treaty (BIT) with Canada in the case of nationalization of Las Cristinas gold mine contracts owned by Crystallex International from 2011-2016. The theory contains two variables, reputational sanctions and direct sanctions along with indicators that provide predictions about when a country will choose to honor or violate the international law. Based on the variables and its Indicators, the analaysis will focus on the causes of Venezuela as a violator to breach the agreements by assesing to the value of each sanctions.
