Abstract
Penelitian ini membahas konflik hukum tentang kewajiban badan publik untuk mengumumkan informasi publik secara berkala berdasarkan ketentuan dalam pasal 9 ayat (1) UU KIP dan pasal 5 Peraturan Bupati Nomor 2 Tahun 2012 Tentang Pedoman Pengelolaan Pelayanan Informasi Dan Dokumentasi Di Lingkungan Pemerintahan Daerah Kabupaten Pacitan. Berdasarkan hal tersebut, masalah yang dirumuskan yaitu tentang kesesuaian serta peraturan manakah yang digunakan terkait kewajiban badan publik untuk mengumumkan informasi publik secara berkala. Hasil penelitian menunjukkan bahwa terdapat ketidaksesuaian peraturan perihal kewajiban badan publik untuk mengumumkan informasi publik secara berkala dalam UU KIP dengan Peraturan Bupati Nomor 2 Tahun 2012 Tentang Pedoman Pengelolaan Pelayanan Informasi Dan Dokumentasi Di Lingkungan Pemerintahan Daerah Kabupaten Pacitan. Sedangkan peraturan yang seharusnya digunakan adalah UU KIP dengan Peraturan Bupati Nomor 2 Tahun 2012 Tentang Pedoman Pengelolaan Pelayanan Informasi Dan Dokumentasi Di Lingkungan Pemerintahan Daerah Kabupaten Pacitan dapat dikesampingkan.
English Abstract
This study discussed legal conflicts on the obligation of public agency in announcing public information regularly based on the provision of article 9 paragraph (1) of Public Information Disclosure Law and article 5 of Regent’s Regulation number 2 year 2012 about the Guideline of the Management of Information and Document service in Pacitan Regency Government. Thus, the research problems formulated were the conformity and which regulation used regarding the obligation of public agency in announcing public information regularly. The results of the study show that there was discrepancy between the regulation governing the public agency’s obligation in announcing public information regularly contained in the Public Information Disclosure Law with the Regents’ Regulation number 2 year 2012 about the Guideline of the Management of Information and Document Service in Pcitan Regency Government. The regulation that was supposed to be used was the Public Information Disclosure Law while the Regent’s Regulation number 2 year 2012 about the Guideline of Information and Document Service should have been put aside.
