Abstract
Penelitian ini bertujuan untuk mengetahui upaya pengajuan rezim hukum khusus atas penggunaan orbit geostationer oleh Indonesia sebagai negara dengan geografi khusus. Penggunaan wilayah ruang angkasa, terlebih wilayah orbit geostationer, sejatinya diatur pada traktat luar angkasa 1967. Traktat ini dibuat untuk mengatur hal-hal teknis yang berkaitan dengan eksplorasi wilayah antariksa serta peluncuran wahana antariksa. Adapun jenis penelitian ini adalah jenis penelitian normatif dengan metode penelitian Yuridis Normatif yang dilakukan dengan cara mengkaji aspek hukum atau regulasi mengenai ruang angkasa beserta tanggung jawabnya untuk memperoleh data mengenai pengajuan rezim hukum khusus terhadap pemanfaatan wilayah orbit geostationer oleh Indonesia sebagai negara dengan geografi khusus. Berdasarkan hasil penelitian ini maka dapat diketahui bahwa pengajuan rezim hukum khusus atas penggunaan wilayah orbis geostationer mengalami tantangan dan kendala dari segi yuridis ataupun non yuridis, dikarenakan belum adanya amandemen terhadap traktat luar angkasa 1967 yang masih hanya memuat tentang prinsip, norma dasar, dan teknis pemanfaatan, tanpa adanya aspek hukum yang tegas terhadap pemanfaatan wilayah ruang antariksa terlebih orbit geostationer. Serta belum adanya tanggapan persetujuan untuk dibuatnya hukum baru pemanfaatan ruang angkasa oleh negara-negara maju di fora Internasional. Ada keuntungan yang diperoleh apabila rezim hukum khusus atas penggunaan orbit geostationer ini disetujui, yaitu terdapat keuntungan dari segi yuridis dan dari segi non yuridis. Serta bertujuan untuk pemanfaatan ruang angkasa yang adil dan untuk kepentingan seluruh umat manusia sekarang ataupun masa yang akan datang
English Abstract
This study aims to determine the effort of the filing of a special legal regime on the use of geostationary orbit by Indonesia as a country with special geography. The use of the space region, especially the geostationary orbit region, is actually set in the 1967 space tract. This treaty was made to regulate technical matters related to space exploration and the launch of spacecraft. The type of this research is normative research type with normative juridical research method which is done by examining legal aspect or regulation about space and its responsibility to obtain data about the application of special law regime to the utilization of geostationary orbit territory by Indonesia as a country with special geography. Based on the results of this study it can be seen that the filing of a special legal regime on the use of geostationary orbis area experienced challenges and constraints due to the absence of amendments to the 1967 space treaty that still only contains the principles, basic norms and technical utilization, without any legal aspects of the firm Of space space utilization especially geostationer orbit. And there has been no response of approval for the creation of a new law of space utilization by developed countries in international fora. There are advantages obtained when a special legal regime for the use of geostationary orbit is approved, there is a juridical and non-juridical advantage. As well as aiming for fair space utilization and for the benefit of all humanity now or the future.
