Abstract
Pencemaran udara di Kota Surabaya saat ini termasuk dalam kategori pencemaran lingkungan hidup. Oleh karena itu, pencemaran udara di Surabaya perlu untuk dikendalikan, dikelola, dan diawasi dengan baik agar tidak berbahaya bagi kehidupan masyarakat dan tidak menimbulkan kerusakan lingkungan hidup dikemudian hari. Salah satu upaya untuk mengendalikan pencemaran lingkungan hidup atau dalam kasus ini pencemaran udara adalah dengan menjaga kelestarian pepohonan yang berada disekitar jalan raya karena pohon berfungsi untuk menyerap karbon dioksida yang ada diudara dan menggantinya dengan oksigen sehingga udara menjadi bersih dan aman untuk di hirup masyarakat. Dalam upaya untuk mengendalikan pencemaran udara tersebut maka Pemerintah Kota Surabaya mengeluarkan peraturan daerah guna melindungi kelestarian pohon yang ada saat ini agar tetap terjaga kelestariannya sehingga tujuan dari upaya untuk mengendalikan pencemaran udara dapat tercapai. Peraturan daerah yang dimaksud adalah Peraturan Daerah Kota Surabaya Nomor 19 Tahun 2014 Tentang Perlindungan Pohon. Dalam Peraturan Daerah Kota Surabaya Nomor 19 Tahun 2014 terdapat Pasal yang mengatur jelas tentang larangan bagi setiap orang atau badan agar tidak melakukan kegiatan yang dapat merusak pohon dan menyebabkan pohon mati. Berdasarkan fakta, pelanggaran terhadap peraturan daerah tersebut masih terjadi hingga saat ini. Tujuan penelitian ini, yaitu untuk mendeskripsikan dan menganalisis efektivitas penerapan pasal 13 Peraturan Daerah Kota Surabaya Nomor 19 Tahun 2014 terkait larangan-larangan dalam melakukan perlindungan pohon serta untuk mengidentifikasi, mendeskripsikan dan menganalisis faktor-faktor yang menjadi hambatan dalam efektivitas penerapan pasal 13 Peraturan Daerah Kota Surabaya Nomor 19 Tahun 2014 terkait larangan-larangan dalam melakukan perlindungan pohon dan upaya dalam mengatasi faktor-faktor yang menjadi hambatan tersebut.
English Abstract
Air pollution in Surabaya city now included in a category pollution of the living. Hence, air pollution in surabaya need to controlled, managed, and supervised well so harmless for social life and does not cause damage environment in the future. One effort to control pollution of the living or in this case air pollution is to preserve the trees are around the highway for the loss of serves to absorb carbon dioxide that is sky above us and replace it with oxygen so as to the air becomes clean and safe to in breathe the community. In an effort to control air pollution hence the government of the city of surabaya issue regulations regions sustainability in order to protect the tree which is currently to stay awake so the purpose of the effort to control air pollution can be achieved. A regional regulation which referred to are regulation the area of a city surabaya number 19 year 2014 on the protection tree. On regulation the area of a city surabaya number 19 year 2014 on the protection tree there are article that set clear on prohibition of for every person or body in order not to commit activities that may destructive to trees and caused a tree dead. Based on fact, a violation of the local regulations in question still happens until now. The purpose of this research , namely to describe and analyse the effectiveness of the application of article 13 regional regulations city surabaya number 19 year 2014 related prohibition in the conduct of trees as well as protection to identify , described and analyze factors that are obstacles in the effectiveness of the application of article 13 regional regulations city surabaya number 19 year 2014 related prohibition in the conduct of trees and protection efforts in addressing factors that these constraints.
