Abstract
Penelitian ini membahas mengenai perlindungan hukum terhadap nasabah tabungan melalui kesesuaian antara Surat Edaran Bank Indonesia No.17/52/DKSP dengan pelaksanaannya di Bank Jatim Tbk.cabang Madiun. Berdasarkan hal tersebut, masalah yang dirumuskan terkait dengan pelaksanaan perlindungan hukum bagi nasabah tabungan dalam bertransaksi melalui penerapan Standar Nasional Teknologi Chip dan PIN Online 6 (enam) digit untuk kartu ATM di PT. Bank Pembangunan Daerah Jawa Timur Tbk. Cabang Madiun serta hambatan dan upaya yang telah diberikan oleh pihak bank. Hasil penelitian menunjukkan bahwa penerapan teknologi chip dan PIN Online 6 (enam) digit terbukti mampu dalam memberikan perlindungan preventif melalui peningkatan pengamanan dan kualitas kartu ATM. Dalam perlindungan represif, hak nasabah masih belum terpenuhi dengan baik, namun pihak bank telah menawarkan jalur litigasi dan non-litigasi bagi nasabah yang tidak puas dengan hasil penyelesain pengaduan nasabah. Seluruh hambatan Yuridis dan Non-Yuridis dalam pelaksanaan kebijakan telah mendapat upaya penyelesaian dari pihak bank.
English Abstract
This study discussed the legal protection of savings customers through the suitability of Bank Indonesia Circular Letter Number 17 / 52 / DKSP with its implementation in Bank Jatim Tbk. of Madiun Branch. Therefore, the research problems formulated was related to the implementation of legal protection for savings customers in transaction through the application of National Standards of Chip Technology and 6 (six) digits Online PIN for ATM cards at Bank Pembangunan Daerah Jawa Timur Ltd.Branch of Madiun as well as the obstacle and efforts that have been provided by the bank. The finding of the study show that Chip and 6 (six) digits Online PIN Technology has proven to be able to provide preventive protection through increased security and quality of ATM card. In repressive protection, customers’ right are still not met properly. However the bank has offered litigation and non-litigation channel for customers who are not satisfied with the results of customer complaints. All juridical and non-juridical barriers in the implementation of the policy have been solved by the Bank.
