Abstract
Latar belakang dari penelitian ini adalah adanya ketidakefektifan terkait pelaksanaan Pasal 19 Peraturan Daerah Kota Bekasi Nomor 10 tahun 2011 tentang Ketentuan Umum Ketertiban, Kebersihan, dan Keindahan terkait pembinaan terhadap tuna sosial. Menurut Pasal 19, Dinas Sosial memiliki kewajiban untuk melakukan pembinaan dalam bentuk pendidikan dan pelatihan keterampilan terhadap para tuna sosial. Tetapi, pada pelaksanaannya, tuna sosial yang tertangkap razia hanya ditaruh di dalam sel atau rumah singgah, kemudian setelah beberapa hari dilepaskan kembali ke jalanan. Apabila melihat dari hambatan-hambatan yang terjadi dalam pelaksanaan pembinaan tuna sosial tersebut, jika ditinjau menggunakan perspektif efektivitas hukum, maka ada ketidaksesuaian antara peraturan dan pelaksanaannya di lapangan.
English Abstract
This study was triggered by the ineffectiveness of implementation of Article 19 of Bekasi Regional Regulation Number 10 Year 2011 on the Provision of Order and Cleanliness related to the training for socially-deprived people. According to Article 19, Department of Social is obliged to provide coaching in the forms of education and skill training to the socially-deprived people. In the implementation, the socially-deprived people who are caught are put in the lain or a house to be freed back to the street couple of days later. The obstacles encountered in the implementation of coaching to socially-deprived people, viewed from the perspective of effectiveness of law, show the missmatch between the regulation and its implementation
