Abstract
Perlindungan hukum bagi tuna rungu ditinjau dari kecakapan bertindak dalam perjanjian jual beli tanah diharapkan akan mampu menyingkirkan rintangan fisik dan perilaku masyarakat yang tidak inklusif serta kebijakan negara yang lebih adil dan bermartabat. Penelitian ini menggunakan metode yuridis normatif dengan menganalisa ketentuan Pasal 433 KUHPerdata yang dikaitkan pula dengan Pasal 1320 KUHPerdata tentang syarat sah suatu perjanjian dan Pasal 1329 KUHPerdata tentang kecakapan bertindak. Karena stigma bahwa disabilitas tuna rungu bukanlah orang yang cakap hukum dikukuhkan dalam buku 1 KUHPerdata Pasal 433. Dari hasil penelitian yang telah dilakukan dapat diketahui bahwa terdapat beberapa ketentuan dalam undang-undang Pasal 433 KUHPerdata, Pasal 1320 KUHPerdata tentang syarat sah suatu perjanjian dan Pasal 1329 KUHPerdata tentang kecakapan bertindak kurang dapat mewadahi dan dalam memberikan perlindungan hukum terhadap hak-hak disabilitas tuna rungu dalam prose jual beli tanah di indonesia. Maka dari itu perlu dilakukan upaya-upaya agar undang-undang tersebut dapat memberikan perlindungan hukum bagi disabilitas tuna rungu dalam melakukan proses jual beli tanah. Adapun upaya-upaya tersebut meliputi : a) menjelaskan secara detail batas atau derajat atau ukuran kecakapan secara lebih rinci, hal ini disebabkan banyak terdapat disabilitas tuna rungu yang memiliki kecakapan hukum setara dengan manusia normal pada umumnya, b) bentuk perlindungan hukum bagi disabilitas tuna rungu telah jelas diatur dalam undang-undang, c) penerapan asas hukum/doktrin.
English Abstract
Law protection for deaf people based on their capability to perform in land purchase and sale agreement is to be expected to eliminate physical barrier and behavior of people who are not inclusive, and also the policy of the state can be more justified and dignified. This research used normative juridical method and analyzed article 433 of civil code which also linked to article 1320 of civil code about the valid requirement of an agreement and article 1329 civil code about the capability to perform. Due to the stigma that people who loses their hearing ability is legally incapacitated in law confirmed in book 1 of civil code article 433. Based on the research that had been done, it can be known that there are some conventions in act article 433 of the civil code and article 1320 of the civil code about the capability to perform. The civil code is less able to accommodate and gives law protection towards deaf people in fulfilling their rights in the process of land purchase and sale in Indonesia. Thus, several efforts need to be done, so the acts can give law protection to the deaf in the process of land purchase and sale. Therefore, the efforts that can be done are: a) explaining length about the limitation or degree or standard of capability at detail, b) the form of law protection for deaf people has been clearly set out in the acts, c) implementing legal principle or doctrine.
