Abstract
Pada penelitian ini, penulis mengangkat permasalahan pelaksanaan putusan pengadilan yang memiliki kekuatan hukum tetap oleh Kantor Pertanahan Kota Depok sebagaimana diwajibkan dalam pasal 58 ayat (1) Permen ATR/BPN No. 11/2016 tentang Penyelesaian Kasus Pertanahan. Pemilihan tema dalam penelitian ini bertolak dari kasus permohonan pelaksanaan putusan pengadilan milik Dr. Adjit Singh atas sebidang tanah di Kelurahan Ratu Jaya, Depok, yang pelaksanaannya memakan waktu begitu lama di Kantor Pertanahan Kota Depok. Dalam pelaksanaannya pada kasus Dr. Adjit Singh, pasal 58 ayat (1) Permen ATR/BPN No. 11/2016 dapat dilaksanakan oleh Kantor Pertanahan Kota Depok, namun memakan waktu yang lama hingga terjadi keterlambatan dalam penerbitan surat keputusannya. Hal tersebut terjadi karena terdapat 4 (empat) hambatan dalam pelaksanaannya dan atas hambatan-hambatan tersebut, Kantor Pertanahan Kota Depok telah melakukan 4 (empat) upaya untuk mengatasi seluruh hambatan yang ada.
English Abstract
This study discussed the issue on the implementation of court’s decision wich has a fixed legal standing by the Land Registry Office of Depok as stated in article 58 paragraph (1) of the regulation of Minister of Agrarian And Spatial Planning/the Head of National Land Authority Number 11/2016 about the land case settlement. This topic was chosen based on the case of request on the implementation of court decision for Dr. Adjit Singh over a piece of land in Ratu Jaya sub-distric, Depok wicht took longer for the implementation in the Land Registry Office in Depok. In the implementation based on the case of Dr. Adjit Singh, article 58 paragraph (1) of the Regulation of Minister of Agrarian and Spatial Planning/the Head of National Land Authority Number 11/2016 could be resulted in the delay of the issuance of the decree. It happened because of 4 (four) obstacles encountered in the implementation the Land Registry Office had found 4 (four) solutions to over come the problems.
