Abstract
Pengelolan Barang Milik Daerah berupa tanah dapat dilakukan oleh pihak lain salah satunya Pemerintah Desa. Namun Pengelolaan Barang Milik Daerah oleh Pemerintah Desa belum secara tegas diatur oleh hukum positif di Indonesia. Tujuan dari penelitian ini untuk mengetahui kewenangan dan struktur kelembagaan pengelolaan Barang Milik Daerah oleh Pemerintah Desa dan bentuk- bentuk sanksi yang dapat dikenakan jika terjadi pelanggaran dalam tata kelolanya. Teknik analisis data yang digunakan adalah huermenetik dan sistematis. Hasil dari penelitian ini adalah, Pemerintah Kabupaten Badung melakukan pelanggaran administratif yaitu kelalaian dalam penatausahaan Barang Milik Daerah yang dioperasikan Desa Canggu dan Desa Cemagi semenjak tahun 1997. Sehingga mengakibatkan Pemerintah Kabupaten Badung seharusnya dikenakan sanksi , namun bentuk sanksi yang sesuai belum diatur di Peraturan Perundang – undangan yang ada sehingga mengakibatkan kekaburan hukum.
English Abstract
Management of goods to regions can be carried out by other parties which is the village administration. However, management of goods belonging to regions by the village administration has not clearly stated by the positive law in Indonesia. This research aims to find out the authority and the institutional structure of the management of goods belonging to an area by the village administration and the forms of sanctions that can be worn if there is a violation in its implementation. To analyze the data the researcher used huermenetics and systematic interpretation. The result of this research is , the government of Badung regency has done administrative infringements that is an omission in organized the goods belonging to a region that is operated by village administration of Canggu and village administration of Cemagi since 1997. Thus, it causes the government of Badung regency should have been worn sanctions, however the appropriate form of sanctions have not been managed in the regulation that led to the vague of law .
