Abstract
Tesis ini bertujuan untuk mengkaji Bagaimana kekuatan hukum perjanjian tukar menukar barang (Ruilslag) tanah yang dituangkan kedalam Surat Keputusan (SK) Bupati Jembrana dan apa akibat hukumnya dan Apakah perjanjian Tukar Menukar (Ruilslag) tanah yang dituangkan dalam Surat Keputusan (SK ) Bupati Jembrana dapat memenuhi nilai keadilan. Jenis penelitian ini merupakan penelitian hukum normatif (Normative Legal Research) yang mengunakan pendekatan perundang-undangan (Statute approach), pendekatan konseptual. (konseptual approach) dan pendekatan kasus (case approach) Kemudian dibantu dengan bahan-bahan hukum yang akan diuraikan, dideskripsikan, dan dianalisis keterkaitan satu sama lain. Dalam penelitian ini dapat ditemukan Perbuatan hukum tukar menukar Pelepasan asset Tanah dan bangunan bekas kantor Camat Negara dengan Keputusan Bupati Jembrana Nomor 1582 Tahun 2004. Perjanjian hukum tukar menukar yang dibuat dengan Keputusan Bupati Jembrana (Pemerintah Daerah).tidak mempunyai kekuatan hukum, karena tukar menukar harus dibuatkan Akta otentik oleh pejabat yang berwenang. Dan juga dapat dimintakan pembatalan karena tidak dipenuhinya unsur subjektif. Dalam perjanjian tukar menukar barang (Ruilslag) antara pemerintah daerah dan perorangan, dalam hal mengenai kewenangan pemerintah Kabupaten Jembrana untuk menukar barang asset sesuai dengan PP Nomor 27 Tahun 2014 tentang pengelolaan Barang Milik Negara/daerah secara spesifikpasal 64 ayat (1) boleh melakukan tukar menukar barang/asset daerah, asalkan memenuhi ketentuan pasal 64 ayat (2) tersebut. Akan tetapi dari aspek teori perundang-undangan, serta mengacu pada UU No 11 Tahun 2012 tentang Hierarki peraturan perundng-undangan.Peraturan daerah/ Keputusan. Tidak ditemukan secara khusus terkait proses tukar menukar dengan menggunakan Keputusan Bupati.hal ini menjadi suatu ke alpaan dari pihak pemerintah daerah dalam melakukan perbuatan hukum tukar munukar barang milik Negara. Dan juga bertentangan dengan pasal 37 Peraturan pemerintah Nomor 24 tahun 1997. Dijelaskan bahwa peralihan hak atas tanahdan hak milikatas satuan rumah melaluijual beli, tukar menukar , hibah, pemasukan dalam perusahaan, dan perbuatan hukum pemindahan hak lainnya (kecuali lelang) hanya dapat didaftarkan jika dibuktikan dengan akta otentik yang dibuat oleh PPAT yang berwenang menurut perundang-undangan yang berlaku. Perjanjian tukar menukar yang dilakukan Pemerintah Kabupaten Jembrana tidak mempunyai kekuatan hukum,karena suatu peralihanhak dengan cara tukar menukar, berdasarkan pasal 37. PP 37 Tahun 1997. Mensyaratkan untuk dibuatkan Akta Tukar menukar, perbuatan pemerintah daerah tersebut berpotensi untuk dilakukan suatu gugatan ke Pengadilan Tata Usaha Negara karena suatu ke alpaan pemerintah daerah dalam melakukan tindakan hukum. Perjanjian tukar menukar antara pemerintah Kabupaten Jembrana dengan perorangan berdasarkan SK Bupati Nomor 1582.bertentangan dengan KMK Nomor 350/KMK/.03/1994. Tentang pelaksanaan mekanisme tukar menukar barang Negara/asset daerah, berdasarkan hasil analisis.pelaksanan tukar menukar barang tersebut menimbulkan ketidakadilan antara pihak, khususnya pemilik sertifikat hak milik nomor 2070 tahun 1990 atas nama I Nyoman Sukra.
English Abstract
This tesis aims to examine how the power of the law of exchange agreement of goods (Ruilslag) of land is poured into the Decree of the Regent of Jembrana and what is the effect of the law and Is the agreement of the Land Exchange (Ruilslag) as stated in the Decree of the Regent of Jembrana can Meet the value of justice. The exchange law agreement made with the Decision of the Regent of Jembrana (Regional Government) does not have the force of law, since the exchange must be made authentic by the authorized official. And can also be requested for cancellation due to the non-fulfillment of subjective elements. In the exchange agreement of goods (Ruilslag) between local governments and individuals, in the case of the authority of the Jembrana Regency government to exchange asset goods in accordance with Government Regulation No. 27 of 2014 on the management of State / Regional Goods specified 64 paragraph (1) may exchange Goods / assets area, Provided that they comply with the provisions of article 64 paragraph (2). Requiring to be made an Exchange Deed of exchange, the act of the local government has the potential to be filed a lawsuit to the State Administrative Court due to an admission of local government in taking legal action. The exchange agreement between Jembrana regency government and individual based on Decree of Bupati Number 1582. contrary to KMK Number 350 / KMK / .03 / 1994. On execution of exchange mechanism of goods of State / asset area, based on result of analysis. The exchange of goods execution caused injustice between party, especially owner of certificate of property number 2070 year 1990 on behalf of I Nyoman Sukra.
