Abstract

Indonesia merupakan Negara Hukum, hal tersebut menjadi fundamentalitas tiap warga negara Indonesia agar menjadi sadar hukum. Dimana hal yang paling mengintegrasi hukum di Indonesia adalah dari sektor ekonomi, sehingga produk hukum di Indonesia banyak menghasilkan tata acuan dan prosedur yang layak dengan mengedepankan sistem Demokrasi Ekonomi. Sejalan dengan hal tersebut, Komisi Pengawas Persaingan Usaha(KPPU) yang merupakan lembaga Quasi Yudisial adalah salah satu manifestasi produk hukum dalam sektor Ekonomi. Gencarnya persaingan usaha tidak sehat dan praktek monopoli oleh oknum Pelaku Usaha menjadi rintisannya. Bagaimanapun juga, aktifitas Pelaku Usaha tidak boleh melanggar sistem Demokrasi Ekonomi di Indonesia, meskipun ada hak konstitusional Pelaku Usaha dalam berkehidupan. Namun permasalahan tidak berhenti demikian ketika Pelaku Usaha yang berbentuk Badan Hukum Perseroan Terbatas(PT) menjalankan kegiatannya, mereka diawasi dengan regulasi Pemerintah dan juga Peraturan KPPU bilamana roda usahanya melakukan Restrukturisasi. Terlebih muncul disparitas kepastian hukum baik terhadap Badan Hukumnya maupun regulasi yang terkait tersebut. Hal yang meresahkan dan menimbulkan ketidakadilan tentunya bila tidak ditelaah lebih dalam secara ilmiah. Dari situlah penulis tertarik untuk menelaah/mengkaji lebih mendalam mengenai hal tersebut, sehingga penulis dapati Judul Tesis “Disparitas Kepastian Hukum Terhadap Pra dan Post Notifikasi Perusahaan.”

English Abstract

Indonesia was state of law, that is the fundamentaly base of every citizen to be aware of the law. Which have most point integrated for law is from Economy Sector, that what makes Indonesian regulation has many reasonable directive and procedure within Economic Democration system for the first one. In Line with this, Komisi Pengawas Persaingan Usaha(KPPU) is institution who had Quasi Yudicial authority was one of law manifest on ecomomic sector. Appearance Antitrust and Monopoly Practism by some bussinessmas is the beginning. However, bussinessman activity didn’t allowing to broke Economic Democation system in Indonesia, although every bussinessman have an constitutional right for their life. Even though the case didn’t stop yet, when the bussinessman make an legal entity into Perseroan Terbatas(PT) for their activity, they are controlled by goverment regulation and also KPPU regulation if their bussines have a restruction enitity. Especially if disparity come up base their conviction, in terms of their Legal Entity or maybe their regulation what relevance. That’s surely make worried and unfair perception if there are not some scientific research. That’s why I get interested to research more deeply about this thing, then I’m sure to make a Thesis with title “Conviction Disparity of Law about Pra and Post Notification Company.”
