Abstract

Pendaftaran Tanah Sistematis Lengkap merupakan salah satu progam tahunan yang dilaksanakan oleh Kementerian ATR/BPN. Tujuan progam ini adalah pemberian jaminan hukum atas kepemilikan tanah dengan biaya murah kepada masyarakat. Distribusi pemberian kuota bidang tanah merata di seluruh Indonesia, salah satunya di Kota Batu pada tahun 2023. Kota Batu mendaPatkan kuota sebanyak 5007 bidang, dan sebagai salah satu penerima progam PTSL di Kota Batu, Desa Pesanggrahan mendapatkan kuota sebesar 1000 bidang. Pelaksanaan berjalan sesuai dengan ketentuan Permen ATR/BPN Nomor 6 Tahun 2018 tentang Pendaftaran Tanah Sistematis Lengkap. Namun kenyataan dilapangan konflik mengenai tanah tetap terjadi. Oleh karena itu peneliti menggunakan konsep relasi kuasa pengetahuan Michel Foucault dalam melihat fenomena pelaksanaan Pendaftaran Tanah Sistematis Lengkap. Menurut Foucault, relasi kuasa sangat berkaitan erat dengan pengetahuan. Dalam praktik pelaksanaannya, ternyata dapat emmicu konflik antara kelompok yang berkuasa dengan yang dikuasai. Hal inijuga dapat dilihat dalam fenomena pelaksanaan Pendaftaran Tanah sistematis Lengkap di Desa Pesanggrahan. Penelitian ini menggunakan metode deskriptif kualitatif dengan metode pengumpulan data wawancara, observasi, dan dokumentasi. Hasil dan pembahasan yang didapatkan Pendaftaran Tanah Sistematis Lengkap di Desa Pesanggrahan berjalan sejak tahun 2022 sampai pertengahan tahun 2024. Pelaksanaan dimulai sejak pendaftaran, sosialisasi, pemberkasan, pengukuran tanah, hingga pembagian sertifikat tanah. namun dalam pelaksanaanya, terdapat beberapa masalah pertanahan seperti pembagian waris, batas tanah, dan pemberian kuota tanah yang tidak sesuai. Konflik tersebut kemudian diselesaikan dengan cara konsiliasi jika konflik intern keluarga dan protes terhadap pihak yang bersangkutan. Dengan begitu pelaksanaan PTSL dapat berjalan sesuai dengan timeline dan tujuan yang telah ditentukan dengan tetap melibatkan pihak terkait

English Abstract

Complete Systematic Land Registration is one of the annual program implemented by the Ministry of ATR/BPN. The purpose of the program is to provide legal security over land ownership at low cost to the community. The distribution of land parcel quotas is evenly distributed throughout Indonesia, one of which is in Batu City in 2023. As one of the recipients of the PTSL program in Batu City, Pesanggrahan Village received a quota of 1000 parcels. The implementation runs in accordance with the provisions of Permen ATR / BPN Number 6 of 2018 concerning Complete Systematic Land Registration. However, in reality in the field, conflicts over land still occur. This research uses descriptive qualitative method with data collection methods of interview, observation, and documentation.
