Abstract
Kasus kekerasan seksual di lingkungan perguruan tinggi menjadi fenomena “gunung es”. Banyaknya Kasus kekerasan seksual di lingkungan perguran tinggi yang tidak dapat diselesaikan dengan baik, hal tersebut dikarenakan sempat adanya kekosongan hukum. Beberapa kampus seperti Universitas Brawijaya pada tahun 2020 memiliki peraturan internal berupa Pertor Nomor 70 Tahun 2020, ditahun berikutnya disahkannya Permendikbudristek Nomor 30 Tahun 2021. Implementasi aturan tersebut untuk melindungi seluruh warga Universitas Brawiajaya dari kekerasan seksual. Tulisan ini memiliki fokus membahas dinamika kasus kekerasan seksual yang terjadi di Universitas Brawijaya sebelum dan sesudah adanya peraturan mengenai penanganan kasus kekerasan seksual di lingkungan perguruan tinggi. Teori yang digunakan adalah Historical Institutionalism dari Guy Peter dan James Mahoney. Penjabaran akan memuat enam (6) instrumen utama yakni Antecedent condition, Critical juncture, Reactive sequence, Path dependence, Structural persistence, dan outcome. Menerapkan metode penelitian kualitatif studi kasus dengan teknik pengumpulan data melalui wawancara, dan dokumentasi. Hasil penelitian menunjukan bahawasannya dinamika penanganan kasus kekerasan seksual yang terjadi di Universitas Brawijaya dapat ditelaah dari Antecedent condition, Critical juncture, Reactive sequence, Path dependence, Structural persistence, dan outcome. Tidak adanya perubahan secara radikal terkait penanganan kekerasan seksual sebelum dan sesudah adanya aturan-aturan yang ada. Alasannya adalah kasus kekerasan seksual sering kali dianggap sebagai aib kampus yang bisa diselesaikan secara internal. Namun, seiring dengan berjalannya waktu, pada tahun 2023 penanganan kasus kekerasan seksual Universitas Brawijaya semakin membaik.
English Abstract
Cases of sexual violence in the university environment have become an "iceberg" phenomenon. The number of cases of sexual violence in the higher education environment cannot be resolved properly, this is because there was a legal vacuum. Several campuses such as Brawijaya University in 2020 have internal regulations in the form of Pertor Number 70 of 2020, the following year the Permendikbudristek Number 30 of 2021 was passed. The implementation of these rules is to protect all citizens of Brawijaya University from sexual violence. This paper focuses on discussing the dynamics of sexual violence cases that occurred at Universitas Brawijaya before and after the existence of regulations regarding the handling of sexual violence cases in the university environment. The theory used is Historical Institutionalism from Guy Peter and James Mahoney. The description will contain six (6) main instruments, namely Antecedent condition, Critical juncture, Reactive sequence, Path dependence, Structural persistence, and outcome. Applying case study qualitative research methods with data collection techniques through literature study, interviews, and documentation. The results of the research show that the dynamics of handling sexual violence cases that occur at Brawijaya University can be studied from Antecedent conditions, Critical juncture, Reactive sequence, Path dependence, Structural persistence, and outcome. There is no radical change related to the handling of sexual violence before and after the existence of existing regulations. The reason is that sexual violence cases are often considered a campus disgrace that can be resolved internally. However, over time, by 2023 Brawijaya University's handling of sexual violence cases had improved.
