Abstract

Pada skripsi ini, penulis mengangkat permasalahan implementasi prinsip Special and Differential Treatment dalam Agreement on Technical Barriers to Trade terhadap kebijakan European Union Deforestation-free Regulation (EUDR). Topik ini dilatarbelakangi oleh kebijakan EUDR yang mewajibkan pengekspor untuk memenuhi persyaratan due diligence yang ditetapkan sesuai dengan standar Uni Eropa untuk memastikan suatu komoditas dan produk terbebas dari praktik deforestasi, sedangkan negara berkembang akan kesulitan untuk memenuhi standar-standar tersebut. Sementara itu, terdapat prinsip Special and Differential Treatment (SDT) dalam Agreement on Technical Barriers to Trade yang memungkinkan diberikannya keringanan-keringanan bagi negara-negara berkembang apabila terkait dengan penerapan hambatan teknis. Berdasarkan hal tersebut, skripsi ini bertujuan untuk menganalisis implementasi prinsip Special and Differential Treatment dalam Agreement on Technical Barriers to Trade terhadap Kebijakan European Union Deforestation-free Regulation (EUDR). Skripsi ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan (statute approach) dan pendekatan kasus (case approach). Bahan hukum yang diperoleh penulis akan dianalisis dengan menggunakan teknik analisis preskriptif yaitu metode analisis yang memberikan penilaian tentang objek yang diteliti apakah benar atau salah atau apa yang seharusnya menurut hukum. Dari hasil penelitian dengan metode di atas ditemukan bahwa prinsip SDT dalam Agreement on Technical Barriers to Trade dapat diterapkan terhadap EUDR apabila negara berkembang memenuhi kriteria-kriteria SDT dalam hal meminta penundaan atau keringanan terhadap persyaratan due diligence. Kriteria-kriteria tersebut diantaranya yaitu: membuktikan status negara berkembang; membuktikan bahwa komoditas dan produk yang disengketakan berdampak pada kebutuhan pembangunan, keuangan, dan perdagangan negaranya; dan membuktikan suatu hambatan teknis merupakan tindakan yang tidak dapat dibenarkan. Indonesia memenuhi kriteria SDT dalam konteks penerapan EUDR sehingga Indonesia dapat meminta penundaan dan keringanan terhadap persyaratan due diligence dalam EUDR.

English Abstract

In this research, the author raises the issue of the implementation of the Special and Differential Treatment principle in the Agreement on Technical Barriers to Trade towards the European Union Deforestation-free Regulation (EUDR) policy. This topic is motivated by the EUDR policy that requires exporters to fulfil due diligence requirements set in accordance with European Union standards to ensure that commodities and products are free from deforestation practices, while developing countries will find it difficult to meet these standards. Meanwhile, there is the principle of Special and Differential Treatment (SDT) in the Agreement on Technical Barriers to Trade that allows waivers for developing countries when it comes to the application of technical regulations. Based on the above, this research aims to analyse the implementation of the Special and Differential Treatment principle in the Agreement on Technical Barriers to Trade towards the European Union Deforestation-free Regulation (EUDR) Policy. This research uses normative legal research methods with a statute approach and case approach. The legal materials will be analysed using prescriptive analysis techniques, namely analytical methods that provide an evaluation of the object under the research whether it is justified or unjustified or what corresponds to the law. From the research using the above methods, it was found that the SDT principle in the Agreement on Technical Barriers to Trade can be applied to EUDR if developing countries meet the SDT criteria in terms of requesting delays or waivers of due diligence requirements. These criteria include: proving the status of a developing country; proving the disputed commodities and products have an impact on the development, financial, and trade needs of the country; and proving a technical barrier is unjustified. In this case, Indonesia fulfils the SDT criteria, allowing it to request a postponement or waiver to comply with the due diligence requirements in the EUDR.
