Abstract

In this thesis, the author raises the issue of Verbal Sexual Violence which often occurs in Indonesia. Verbal Sexual Violence has actually been regulated in the Sexual Violence Crime Law Number. 12 of 2022, but in this law there are still many deficiencies, both in terms of victim protection, evidence and limitations on Verbal Sexual Violence. In the midst of these deficiencies, the presence of the Verbal Sexual Violence Law is a very good breakthrough in regulating Verbal Sexual Violence. Based on these reasons, this paper raises the formulation of the problem: (1) How is the regulation of Crimes of Sexual Violence in Indonesia? and (2) How is the protection for victims of Verbal Sexual Violence?. Then the writing of this research uses the Normative Juridical research method with the concept approach method, statutory approach and comparative approach. Primary legal materials obtained are divided into three primary legal materials sourced from laws and regulations, secondary legal materials sourced from literature containing information about primary legal materials, tertiary legal materials, tertiary legal materials are legal materials that provide instructions or explanations of primary legal materials and secondary legal materials, such as the Big Indonesian Dictionary, Blacklaw Dictionary, legal dictionaries, and encyclopedias. From the results of research using this method, the authors get answers to the formulation of the problem that has been compiled that the Law on Crime of Sexual Violence actually regulates and defines Verbal Sexual Violence itself. However, according to the author, there is a need for renewal related to victim protection, Proof of Verbal Sexual Violence Crime and what are the boundaries of Verbal Sexual Violence so that it does not become multi-interpreted in formulating the Crime. The synergy of legislators is highly expected so that the Formulation of the Crime of Verbal Sexual Violence can accommodate all the needs and interests of the partners.

English Abstract

Didalam skripsi, Penulis mengangkat permasalahan tentang Kekerasan Seksual Verbal yang kerap kali terjadi di Indonesia. Kekerasan Seksual Verbal sejatinya sudah diatur dalam Undang- Undang Tindak Pidana Kekerasan Seksual Nomor. 12 Tahun 2022, namun dalam Undang undang tersebut masih banyak sekali ditemukan kekurangan,baik dari segi perlindungan korban, pembuktian dan batasan atas Kekerasan Seksual Verbal tersebut. Ditengah kekurangan tersebut hadirnya Undang-undang Kekerasan Seksual Verbal ini merupakan terobosan yang sangat baik dalam mengatur Kekerasan Seksual Verbal.Berdasarkan alasan tersebut, Karya tulis ini mengangkat rumusan masalah: (1) Bagaimana pengaturan Tindak Pidana Kekerasan Seksual di Indonesia? dan (2) Bagaimana Perlindungan korban Tindak Pidana Kekerasan Seksual Verbal?. Kemudian penulisan penelitian ini menggunakan metode penelitian Yuridis Normatif dengan metode pendekatan konsep, pendekatan perundang-undangan dan pendekatan perbandingan. Bahan hukum Primer bersumber dari Peraturan Perundang-undangan, Bahan Hukum Sekunder yang bersumber dari pustaka yang berisikan informasi tentang bahan hukum primer, Bahan Hukum Tersier, Bahan hukum tersier adalah bahan hukum yang memberikan petunjuk maupun penjelasan terhadap bahan hukum primer dan bahan hukum sekunder, seperti Kamus Besar Bahasa Indonesia, Blacklaw Dictionary, kamus hukum, dan ensiklopedia. Dari hasil penelitian dengan metode tersebut, penulis mendapatkan jawaban atas rumusan masalah yang tekah dirangkai bahwa Undang-undang Tindak Pidana Kekerasan Seksual sejatinya sudah mengatur dan mendefinisikan Kekerasan Seksual Verbal itu sendiri. Namun menurut penulis perlu adanya pembaharuan terkait perlindungan korban, Pembuktian Tindak Pidana Kekerasan Seksual Verbal serta bagaimana batasanbatasan Kekerasan Seksual Verbal itu agar tidak menjadi multitafsir dalam merumuskan Tindak Pidana tersebut. Sinergitas para pembuat undang-undang sangat diharapkanii agar Rumusan Tindak Pidana Kekerasan Seksual Verbal dapat mengakomodir seluruh keperluan dan kepentingan para pihak
