Abstract

Dalam Skripsi ini Problematika Hukum yang diangkat oleh penulis ialah adanya ketidaklengkapan pengaturan mengenai hak cipta untuk ciptaan berupa font dan typeface pada Undang-Undang Nomor 28 tahun 2014 tentang Hak Cipta. Akibatnya, Undang-Undang tersebut tidak dapat memberikan kepastian hukum yang dibutuhkan oleh setiap individu, terutama pencipta dan pemegang hak cipta font dan typeface. Berbeda dengan Indonesia di Negara Amerika Serikat dan Inggris telah mengatur lebih lanjut mengenai font dan typeface, sehingga kedua negara tersebut menjadi negara yang tepat untuk menjadi negara pembanding. Berdasarkan Pemaparan diatas skripsi ini mengangkat rumusan masalah sebagai berikut: (1) Bagaimana analisis ketentuan hak cipta terkait perlindungan Font dan Typeface Berdasarkan Undang-Undang Nomor 28 Tahun 2014 Tentang Hak Cipta? (2) Bagaimana perlindungan hukum yang tepat bagi Pencipta atau Pemegang Hak Cipta terkait hak cipta berupa Font dan Typeface berdasarkan perbandingan dengan Hukum di Amerika Serikat dan Inggris? Kemudian penulisan karya tulisan ini menggunakan metode yuridis normatif dengan metode pendekatan perundang-undangan (statute approach) dan pendekatan perbandingan (comparative approach). Bahan hukum yang diperoleh penulis akan dianalisis dengan menggunakan teknik analisis gramatikal yaitu analisis dengan melakukan penafsiran kata-kata dalam undang-undang dan teknik analisis komparatif yang membandingkan dengan peraturan hukum satu dengan peraturan hukum lainnya. Dari hasil dan pembahasan penelitian ini dengan metode diatas, penulis memperoleh jawaban atas permasalahan yang ada bahwa pada Pasal 40 UndangUndang Nomor 28 Tahun 2014 Tentang Hak Cipta tidak terdapat penjelasan mengenai Ciptaan berupa font dan typeface. Berbeda dengan negara Amerika Serikat dan Inggris yang telah mengatur hak cipta untuk ciptaan berupa font dan typeface, dimana keduanya dianggap sebagai sebuah karya seni serta memiliki pengaturan hukum yang lebih lengkap.

English Abstract

In this thesis, the legal problem raised by the author is the incomplete regulation regarding copyright in the form of fonts and typefaces in Law Number 28 of 2014 concerning Copyright. Because the law does not have a comprehensive explanation. As a result, the Law cannot provide the legal certainty needed by every individual, especially creators and copyright holders of fonts and typefaces. In contrast to Indonesia, the United States and England have further regulated fonts and typefaces, so that these two countries are the right countries to use as comparison countries. Based on the explanation above, this thesis raises the following problem formulation: (1) How is the analysis of copyright provisions related to the protection of fonts and typefaces based on Law Number 28 of 2014 concerning Copyright? And (2) What is the appropriate legal protection for creators or copyright holders regarding copyright in the form of fonts and typefaces based on comparison with law in the United States and England? This research was written using a normative juridical method with a statutory approach and a comparative approach. The legal material obtained by the author will be analyzed using grammatical analysis techniques, namely analysis by interpreting the words in the law and comparative analysis techniques that compare one legal regulation with another legal regulation. From the results of research with the above method, the author obtains the answer to the problem. that in Article 40 of Law Number 28 of 2014 concerning Copyright there is no explanation regarding Creations in the form of fonts and typefaces. This is different from the United States and England which have regulated copyright for creations in the form of fonts and typefaces, both of which are considered visual art and have more complete legal regulations which lead to a law certainty.
