Abstract
Pada skripsi ini, peneliti mengangkat permasalahan mengenai ketidaklengkapan hukum yang dilatarbelakangi oleh belum adanya pengaturan mengenai First Sale Doctrine yang diperuntukkan untuk karya digital di Indonesia yakni UndangUndang Nomor 28 Tahun 2014 tentang Hak Cipta. Dengan melakukan studi komparasi terhadap regulasi di negara Uni Eropa dapat menjadi solusi atas ketidaklengkapan hukum di Indonesia. Berdasarkan latar belakang tersebut, penulis merumuskan rumusan masalah sebagai berikut: (1) Bagaimana analisis pengaturan First Sale Doctrine terhadap karya digital menurut Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta? (2) Bagaimana pengaturan yang ideal First Sale Doctrine terhadap karya digital dalam Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta? Kemudian, dalam penulisan skripsi ini penulis menggunakan metode yuridis normatif dengan metode pendekatan peraturan perundang-undangan, perbandingan, konseptual dan kasus. Dalam menganalisis peraturan perundangundangan tersebut, penulis menggunakan bahan hukum primer, sekunder dan tersier. Bahan hukum tersebut dikumpul dan diolah dengan studi kepustakaan (library research), serta kemudian dianalisis melalui interpretasi sistematis dan komparatif. Dari hasil penelitian dengan menggunakan metode di atas, penulis menarik kesimpulan bahwa pengaturan First Sale Doctrine di Indonesia belum diatur secara spesifik mengenai keabsahan First Sale Doctrine terhadap karya digital dalam Undang-Undang No. 28 Tahun 2014 tentang Hak Cipta. Penulis menemukan bahwa, pengaturan eksisting terkait First Sale Doctrine terhadap karya digital di Uni Eropa yang tercantum dalam Information Society Directive dapat menjadi jawaban atas ketidaklengkapan pengaturan di Indonesia.
English Abstract
In this thesis, the researcher raises the issue of legal incompleteness which is motivated by the absence of regulations regarding the First Sale Doctrine intended for digital works in Indonesia, namely Law Number 28 of 2014 concerning Copyright. By conducting a comparative study of regulations in European Union countries, it can be a solution to the incompleteness of law in Indonesia. Based on this background, the author formulates the problem formulation as follows: (1) What is the analysis of the First Sale Doctrine regulations for digital works according to Law Number 28 of 2014 concerning Copyright? (2) What is the ideal regulation of the First Sale Doctrine for digital works in Law Number 28 of 2014 concerning Copyright? Then, in writing this thesis the author used normative juridical methods with statutory, comparative, conceptual and case approaches. In analyzing these laws and regulations, the author uses primary, secondary and tertiary legal materials. This legal material is collected and processed using library research, and then analyzed through systematic and comparative interpretation. From the results of research using the method above, the author draws the conclusion that the regulation of the First Sale Doctrine in Indonesia has not been specifically regulated regarding the validity of the First Sale Doctrine for digital works in Law no. 28 of 2014 concerning Copyright. The author found that the existing regulations regarding the First Sale Doctrine for digital works in the European Union as stated in the Information Society Directive could be the answer to the incomplete regulations in Indonesia.
