Abstract
Berdasarkan Undang-Undang Nomor 24 Tahun 2011 tentang Badan Penyelenggara Jaminan Sosial dan Instruksi Presiden Nomor 2 Tahun 2021 tentang Optimalisasi Pelaksanaan Jaminan Sosial Ketenagakerjaan, urgensi keikutsertaan pekerja dalam kepesertaan Program Jaminan Sosial Ketenagakerjaan menjadi isu penting, terutama setelah terjadi dinamika ketenagakerjaan di Kota Malang pada saat covid-19 berlangsung maupun pasca covid-19. Tulisan ini secara khusus menjabarkan hasil evaluasi program Jaminan Sosial Ketenagakerjaan Bagi Pekerja Swasta di Kota Malang yang berlandaskan pada teori Institutional Analysis and Development (IAD) oleh Elinor Ostorm. Terdapat tiga variabel pada teori ini, antara lain (1) Variabel Eksternal yang terdiri dari tiga indikator, yakni Rules in Use, Biophysical Condition, dan Attribute of Community). (2) Arena Aksi, (3) Hasil atau Outcomes. Penelitian ini menggunakan metode kualitatif studi kasus di Kota Malang dengan dilakukan wawancara dan dokumentasi sebagai teknik pengumpulan data. Hasil penelitian menunjukkan bahwa program Jaminan Sosial Ketenagakerjaan bagi pekerja swasta di Kota Malang telah didesain dan dijalankan cukup baik sehingga kebermanfaatannya mampu dirasakan oleh pekerja swasta. Namun, dalam pelaksanaannya masih menemui beberapa kendala internal dan eksternal yang menghambat jalannya program, diantaranya masih kurangnya antusiasme dan kesadaran pekerja khususnya pada perusahaan berskala mikro terkait urgensi jaminan sosial ketenagakerjaan, masih adanya perusahaan yang menunggak iuran yang berakibat pada terhambatnya proses klaim dan berujung pada masalah hukum, dan sebagainya.
English Abstract
Based on Law Number 24 of 2011 concerning the Social Security Organizing Agency and Presidential Instruction Number 2 of 2021 concerning Optimization of the Implementation of Employment Social Security, the urgency of workers' participation in the Social Security Employment Program (Jamsostek) is an important issue, especially after the dynamics of employment in Malang City during covid-19 and after covid-19. This paper specifically describes the results of the evaluation of the Employment Social Security program for Private Workers in Malang City based on the theory of Institutional Analysis and Development (IAD) by Elinor Ostorm. There are three variables in this theory, including (1) External Variables consisting of three indicators, namely Rules in Use, Biophysical Condition, and Attribute of Community). (2) Arena of Action, (3) Outcomes . This research uses qualitative method of case study in Malang City with interviews and documentation as data collection techniques. The results showed that the BPJS Employment program for private workers in Malang City has been designed and implemented well enough so that its benefits can be felt by private workers. However, in its implementation, there are still several internal and external obstacles that hinder the running of the program, including the lack of enthusiasm and awareness of workers, especially in micro-scale companies related to the urgency of social security employment, there are still companies that are in arrears with contributions which result in hampering the claim process and leading to legal problems, and so on.
