Abstract

Pada skripsi ini, penulis mengangkat permasalahan mengenai Analisis Efektivitas Peraturan Badan Pengatur Minyak Hilir dan Gas Bumi Nomor 6 Tahun 2015 tentang Penyaluran Bahan Bakar Tertentu dan Bahan Bakar Khusus Penugasan pada Daerah yang belum Terdapat Penyalur Yang melatar belakangi penelitian tersebut yaitu menjamurnya usaha Pertamina Shop di Kabupaten Kediri yang mana usaha tersebut tidak memiliki legalitas hukum dikarenakan pelaku usaha sendiri belum mempunyai surat izin usaha itu sendiri. Berdasarkan hal tersebut diatas, rumusan masalah yang diangkat penulis yaitu: 1. Bagaimana aturan pelaksanaan pendistribusian BBM jenis tertentu dan BBM khusus penugasan di wilayah Kabupaten Kediri yang tidak ada penyalurnya sesuai Peraturan Badan Pengatur Hilir Migas Nomor 6 Tahun 2015 ? 2. Bagaimana seharusnya pendistribusian bahan bakar minyak tertentu dan penugasan bahan bakar minyak khusus dilakukan di tempat-tempat yang saat ini tidak memiliki distributor? Kemudian penulisan karya tulis ini, penulis menggunakan jenis penelitian Sosio Legal, metode yang digunakan menggunakan pendekatan kualitatif, yang coba menelaah suatu konsep hukum yang selama ini masih dianggap sebagai wacana, akan tetapi dalam realitanya sudah sejak lama ada dalam Masyarakat. Jenis dan sumber data, pengumpulan data, Analisis data yang digunakan memperoleh data ialah wawancara dan teknik analisis data penelitian menggunakan teknik deskriptif kualitatif. vii Berdasarkan hasil penelitian yang mana sesuai dengan rumusan masalah serta metode penelitian diatas, penulis menemukan jawaban permasalahan bahwa efektivitas peraturan pelaksanaan Badan Pengatur Hilir Minyak dan Gas Bumi nomor 5 tahun 2015 tentang penyaluran jenis bahan bakar tertentu dan jenis bahan bakar khusus penugasan pada daerah yang belum terdapat penyalur karena kurang berhasil karena pemerintah daerah tidak terlibat langsung dalam pelaksanaan peraturan perundang-undangan sehingga berdampak pada perluasan pelaku usaha Toko Pertamina. Seharusnya hal itu masuk dalam peraturan Badan Pengatur Hilir Migas. melibatkan secara langsung kepada Pemerintah Daerah, guna mempermudah dalam Pengaturan Daerahnya untuk mengatasi permasalahan di daerahnya seperti Pertamina Shop ini yang menjamur.

English Abstract

In this thesis, the writer poses a problem of analyzing the effectiveness of the Downstream Oil and Gas Agency regulations Number 6 of 2015 concerning the Distribution of Certain Fuels and special fuels allocated in Regions where there are no Distributors . The background to this research is the rapid of Pertamina Shop businesses in Kediri Regency where the businesses do not have legal status because the business entities themselves do not have a business license. Based on the above content, The formulation of the problem posed by the writer is as follows.: 1. What are the rules for implementing the distribution of certain types of fuel and special fuel for assignments in the Kediri Regency area where there are no distributors in accordance with Downstream Oil and Gas Regulatory Body Regulation Number 6 of 2015? 2. How should the distribution of specific fuel oil and the assignment of special fuel oil be managed in places that do not currently have a distributor? Then in writing this paper, the author used a type of Socio-Legal research, the method used was a qualitative approach, which tried to examine a legal concept which until now has been still considered a discourse, but in reality it has existed long within the community. Interviews and research data analysis approaches employing qualitative descriptive techniques are among the sources and types of data that are collected. The author has discovered the solution to the issue, which is the efficacy of the research, based on the findings of the study that are consistent with the ix aforesaid problem formulation and research methodologies implementing the regulations of the Downstream Oil and Gas Regulatory Agency number 5 of 2015 concerning the distribution of certain types of fuel and special types of fuel assigned to areas where there are no distributors because the regional government is not directly involved in enforcing laws and regulations, which has an impact on the expansion of Pertamina Shop business actors. In the Regulations, the Downstream Oil and Gas Regulatory authorities should have the direct participation of regional governments in order to make it easier for Regional Regulations to overcome regional problems, such as such as Pertamina store development
